3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO
4 ENTER INTO A CONTRACT WITH POSITIVE RESULTS LAWN
5 SERVICES, INC. IN AN AMOUNT NOT TO EXCEED ONE
6 HUNDRED THIRTY-FIVE THOUSAND, SIXTY-SIX AND 60/100
7 DOLLARS ($135,066.60), FOR THE WEST 57TH STREET
8 DRAINAGE IMPROVEMENT PROJECT; AND FOR OTHER
9 PURPOSES

11 WHEREAS, it has been deemed appropriate and necessary to analyze and design drainage
12 improvements to mitigate and reduce the frequency and severity of flooding in the area along the
13 south side of West 57th Street near Hopson Drive; and,
14 WHEREAS, project improvements include storm drainage to prevent street runoff from
15 flooding adjacent residential yards;and,
16 WHEREAS,bids were solicited for West 57th Street Drainage,Bid#2651;and,
17 WHEREAS,Positive Results Lawn Services,Inc.was the lowest responsive,responsible bid
18 meeting specifications of four(4)bids received;and,
19 WHEREAS, the total cost for this contract shall not exceed One Hundred Thirty Five
20 Thousand, Sixty Six and 60/100 Dollars ($135,066.60), which is the base bid amount of One
21 Hundred Twelve Thousand, Five Hundred Fifty Five and 50/100 Dollars ($112,555.50) plus a
22 Twenty percent(20%)contingency;and,
23 WHEREAS, funding for the project is from the 2022 Capital Improvement Bonds as
24 authorized by Resolution 15,968 (May 2, 2023) with funds available from Account Activity
25 B2D018D;
26 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
27 CITY OF LITTLE ROCK,ARKANSAS:
28 Section 1. The City Manager is hereby authorized to execute an agreement with Positive
29 Results Lawn Service,Inc.in an amount not to exceed One Hundred Thirty-Five Thousand, Sixty-
30 Six and 60/100 Dollars ($135,066.60), which is the base bid amount of One Hundred Twelve
31 Thousand,Five Hundred Fifty-Five and 50/100 Dollars($112,555.50)plus a Twenty percent(20%)
32 contingency.
33 Section 2. Funding for this project is from the 2022 Capital Improvement Bonds as authorized
34 by Resolution 15,968(May 2,2023). Account Activity B2D018D.

1 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
2 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such
3 declaration or adjudication shall not affect the remaining portions of the resolution which shall
4 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional
5 was not originally a part of the resolution.
6 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
7 inconsistent with the provisions of this resolution, are hereby repealed to the extent of such
8 inconsistency.
