3 A RESOLUTION TO REQUIRE A POLICY FOR THE PLACEMENT OF
4 BANNERS ON CITY HALL,INCLUDING THE PROPERTY SURROUND-
5 ING CITY HALL, BE PROMULGATED AND APPROVED BY THE
6 MAYOR AND MEMBERS OF THE BOARD OF DIRECTORS; TO DE-
7 CLARE ESSENTIALY A THREE-MONTH MORATORIUM ON THE
8 PLACEMENT OF ANY SUCH SIGNAGE ON CITY HALL WHILE THE
9 POLICY IS BEING DEVELOPED;AND,FOR OTHER PURPOSES.

11 WHEREAS,the City Hall building at 500 West Markham Street,the corner of Markham Street
12 and Broadway Street, is the designated office building, and the main chamber for the conduct of
13 business by the Little Rock Board of Directors and various City commissions; and,
14 WHEREAS, the placement of banners or signage on City Hall, or the property immediately
15 surrounding City Hall, can be deemed to create a public forum for speech by any group; and,
16 WHEREAS, it is desired that appropriate uses of City Hall and its surroundings be permitted
17 to the extent possible without adversely impacting 1st Amendment rights of any person or organi-
18 zation; and,
19 WHEREAS, the development of such a policy, for approval by the Mayor and Members of
20 the Board of Directors should be completed no later than February 1, 2025, essentially three
21 months from the date of this Resolution:
22 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
23 CITY OF LITTLE ROCK,ARKANSAS:
24 Section 1. From the date of this Resolution until February 1,2025,no person or organization shall be
25 permitted to place any banners on the buildings within the City Hall complex or any other City structure
26 located between Broadway and Chester Street,and Markham Street to the Arkansas River,while a formal
27 policy is drafted and approved to address the placement of such banners.
28 Section 2. The policy to be developed shall include consideration of the placement of signage on City
29 Hall, or the property included in the description contained in Section 1 of this Resolution, provided that
30 temporary signage,that for purposes of this Resolution does not permit banners on City Hall, which notes
31 only an event that is taking place within City Hall shall be permitted only during the day of such event.

1 Section 3. If a policy is researched and drafted and approved by the City Attorney as to its legal form
2 and any possible impact upon the constitutional rights of any person or entity,is adopted by the Mayor and
3 Members of the Board of Directors prior to February 1,2025,this moratorium shall end on the date of such
4 adoption.
5 Section 4. Nothing in this Resolution shall adversely impact the right of persons to hold hand-carried
6 signs within the public rights-of-way,or on property leading to the entrance of public buildings, during the
7 period of this moratorium so long as such action is consistent with the First Amendment to the U.S. Con-
8 stitution,and Article II of the Arkansas Constitution.
9 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
10 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adju-
11 dication shall not affect the remaining portions of the resolution,which shall remain in full force and effect
12 as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the reso-
13 lution.
14 Section 6. Repealer. All laws,ordinances,resolutions,or parts of the same,that are inconsistent with
15 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
