P�' �,,�- � � � 9 �► .� $ p a ,'Pit o cy RA S 1S.13W.3 PD CT Other Matters MABELVALE TOWN PLAT REDUCE TO ACREAGE 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 ORDINANCE NO. 16,144 AN ORDINANCE VACATING A PORTION OF MABELVALE TOWN PLAT AND CLOSING PORTIONS OF THE RIGHT-OF-WAY OF MAIN STREET, WEST THIRD STREET AND ALLEYS IN BLOCKS 4, 5, 12 AND 13, ALL IN THE PLAT OF THE TOWN OF MABELVALE, P[TLASKI COUNTY, ARKANSAS. WHEREAS, the current owner of Blocks 4, 5, 12, and 13 of the Town of Mabelvale Plat has made application for the vacation of portions of said blocks for the purpose of reducing platted land to acreage, pursuant to Little Rock, Ark. Rev. Code § 31-11 (1988); and WAS, the owner has not sold any of the lots within the described area and he is the sole owner of the area to be reduced to acreage; and WtUMEAS, none of the dedicated streets and alleys within the described area have been constructed; and WHEREAS, certain platted public utility easements within the area of the plat to be vacated and reduced to acreage are not vacated by this ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The Board of Directors of the City of Little Rock, Arkansas hereby approves the vacation of portions of the plat of the Town of Mabelvale described herein, together with the divesting of the public rights in the streets and alleys included in the legal description of the portion to be vacated, described as follows: Part of the SE 1/4 of the SW 1/4 AND Part of the SW 1/4 of the SE 1/4 of Section 3, Township 1 South, Range 13 West, Pulaski County, Arkansas, including part of Blocks 4, 5, 12 and 13 of the Town of Mabelvale, as shown in Plat of record in Plat Book 1, at page 157, more particularly described as follows, to wit: Beginning at a point 150.0 feet Northeast of the Northwest corner of Block 21,- Town -of 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 Mabelvale; thence northwesterly through the center of Blocks 12 and 5, a distance of 686.0 feet to the center of a branch; thence Easterly along said center of branch to the North and South centerline of Section 3, Township 1 South, Range 13 West, said point being 380.88 feet south of the Northwest corner of the SW 1/4 SE 1/4 of said Section 3, Township 1 South, Range 13 West and also being the Northwest corner of Tract 1 of Pine Manor Subdivision as recorded in Plat Book 27 at page 15; thence South 000 25' West along the westerly line of said Tract 1 of Pine Manor Subdivision a distance of 203.0 feet; thence North 50° 54' East along the Southwesterly line of said Tract 1 of Pine Manor Subdivision a distance of 188.0 feet; thence South 30° 19' East along the Westerly line of said Tract 1 of Pine Manor Subdivision a distance of 172.0 feet; thence South 89' 51' East along the South line of Tract 1 of Pine Manor Subdivision a distance of 8.23 feet to the Easterly line of Block 13 of said Town of Mabelvale; thence South 34' 00' East along said East line of Block 13 a distance of 136.75 feet to the Northeast corner of Block 20 of said Town of Mabelvale; thence South 550 45' West along the Northerly line of Blocks 20 and 21 of said Town of Mabelvale a distance of 530.0 feet to the point of beginning, containing 5.51 acres, more or less. SUBJECT TO the new right-of-way of Mabelvale Pike and Main Street. PROPERTY ALSO SUBJECT TO any and all Easements, Streets and/or Alley rights -of -way presently platted or otherwise of record. SECTION 2. The City specifically retains the public in and to certain utility easements within the described identified as follows: 1. A Deed for Easement dated January 3, 1983, conveyed by Jonas Corporation to the Mabelvale-Alexander Sewer Improvement District No. 142, filed of record in the Pulaski County Deed Records, Instrument No. 83-00705; and 3. A Right -of -Way Easement conveyed by Jonas Corporation to Mabelvale-Alexander Sewer Improvement District No. 142 dated January 15, 1981, filed of record in the Pulaski County Deed Records, Instrument No, 81-05651. SECTION 3. This ordinance shall be in full force and effect from and after the date of its passage.
