WHEREAS, Chenal Commercial Partnership, an Arkansas General Partnership,
hereinafter called "Grantor" is the owner of real property which has been preliminarily
platted as Lots 1, 2, and 4 of the Commercial Park Addition to the City of Little Rock,
Pulaski County, Arkansas ("Grantor's Property") as depicted on the Attached Exhibit
A; and
WHEREAS, Grantor desires to final plat Lot 1 and to simultaneously file a Bill
of Assurance which shall apply to all of Grantor's Property including Lot 1.
NOW, THEREFORE, in addition to any other plats of portions of the Chenal
Park Addition previously filed, Grantor has caused to be made a Plat, filed herewith,
prepared by White-Daters & Associates, Inc., a Registered Land Surveyor, dated
2015, showing a survey made by Paul M. White, a Registered Land
urveyor, bearing a certificate of approval executed by the City of Little Rock and
showing thereon the metes, bounds and dimensions of that particular property which
Grantor is now desirous of subdividing and platting into a Lot and public street right-
of-way and which is more particularly described as follows, to -wit:
Grantor warrants and represents that it has laid off, platted, and does hereby
lay off, plat and subdivide the Lot hereinabove described in accordance with the
aforesaid Plat. The land described and embraced in the Plat shall be forever known as
Lots 1, 2, and 4 Chenal Commercial Park, an Addition to the City of Little Rock,
Pulaski County, Arkansas, and any and every deed of conveyance of said Lot

description thereof.
Grantor's Property shall be subject to that certain Declaration of Easements,
Covenants, Conditions and Restrictions dated June 3, 2015 filed on June 3, 2015 as
Instrument No. , copy attached as Exhibit C, and shall be used
for purposes allowed under applicable zoning ordinances of the City of Little Rock,
Arkansas. All building codes and zoning ordinances of the City of Little Rock shall be
applicable.

DECLARATION OF COVENANTS AND RESTRICTIONS
Lot 1 and lands to be platted as Lots 2 and 4, Chenal Commercial Park Addition, City of
Little Rock, Pulaski County, Arkansas (the "Property")
This Declaration of Covenants and Restrictions ("DCR") made this 3rd day of June, 2015
by the Chenal Commercial Partnership, an Arkansas General Partnership, hereinafter
referred to as "Grantor".
ARTICLE 1: Purpose
1.1 The Property is hereby made subject to the following conditions, covenants,
restrictions and reservations all of which shall be deemed to run with the Property
and each and every part thereof to insure proper use and appropriate
development and improvement of said Property so as to (a) protect the Owner
against such improver development and uses of surrounding parcels as will
depreciate the value and use of their parcels; (b) prevent the erection on the
Property of structures constructed of improper or unsuitable materials or with
improper quality and methods of construction; (c) insure adequate and
reasonable consistent development of the Property; (d) encourage and assure
the erection of attractively designed permanent improvements appropriately
located within the Property in order to achieve harmonious appearance and
function; € to provide adequate off-street parking; and (f) generally promote the
welfare and safety of the each lot owner.
ARTICLE 2: Definitions
2.1 "Grantor" shall mean Chenal Commercial Partnership, an Arkansas General
Partnership its successors and assigns.
2.2 "Owner" shall mean and refer to the record owner, whether one or more
persons or entities, of the fee simple title to any of the Property, but excluding
those having any interest merely as security for the performance or payment of
an obligation.
2.3 "Property" shall mean and refer to the real property described as the land which
has been preliminarily platted as Lots 1, 2, and 4 of the Chenal Commercial Park
Addition to the City of Little Rock, Pulaski County, Arkansas.
2.4 "Improvements" shall mean and include, but not be limited to, buildings, parking
areas, loading areas, fences, walls, hedges, landscaping, mass plantings, poles,
signs, and any structures of any type or kind.
2.5 "Lot" shall mean and refer to the fee simple absolute estate of any platted plot
of land within the Property, as heretofore and hereafter platted.
2.6 "Plat" shall mean and refer to a certain drawing which is approved by the City of
Little Rock and filed with the Circuit Clerk platting a Lot.
ARTICLE 3: Easements
3.1 A permanent easement or easements for drainage and for the installation,
maintenance, repair and replacement of utility services, storm and sanitary
sewers and drainage are created, accepted and reserved on, over, across and
through to the Lot as shown on the Plat filed herewith and any Plat filed
hereafter. No structures or buildings or similar permanent improvements shall be
built, constructed, erected, installed, placed or maintained within the area of
easements. No excavations within the area of said easements for the erection of
any fences or for any other purposes shall be made which would interfere with
installation, maintenance, repair and replacement of any utility, storm or sanitary
sewer, or drainage services. In the event any trees, incinerators, structures,
buildings, fences, pavement or similar improvements shall be growing on or be
constructed, erected, installed, placed, built or maintained within the area of
any such easement, no utility provider will be liable for the destruction of same in
the installation, maintenance, repair or replacement of any utility or drainage
services located within the area of such easement.
ARTICLE 4: Permitted Uses
4.1 In the development, use or ownership of all or any portion of the Property the
Owner thereof shall develop, use and or occupy the Property in compliance with
all of the ordinances of the City of Little Rock, including the zoning rules and
regulations in effect from time to time as well as any and all other applicable
governmental entities as they apply to any particular portion of the Property.
ARTICLE 5: Regulation of Improvements
5.1 Setbacks: No building shall be located on any Lot nearer to the front, side or rear
lot lines than the minimum building setback lines shown on any recorded Plat
affecting the Property.
5.2 Sidewalks: Sidewalks shall be installed by the Owner along abutting streets as
may be required by the City of Little Rock.
5.3 Subdividing: No Lot shall be subdivided without the prior written consent of the
Developer and the City of Little Rock first having been obtained.
5.4 Building Exteriors: The exterior of all improvements on any Lot shall comply with
the following.
5.4.1 The permitted materials for exterior wall elevations will be 100% masonry or
equivalent. Masonry or equivalent shall include face brick, architectural pre -cast
concrete panel, pre -finished curtain wall construction in conjunction with face
brick, glass curtain wall or other materials when approved in writing by Grantor.
Grantor may approve reasonable variations in construction materials which are
in substantial compliance with the above specifications in both value and visual
qualities.
5.4.2 All equipment; whether it is roof mounted and visible from the ground; or
whether it is ground mounted, is to be screened and painted to match the
exterior material of the building.
5.4.3 Gutters and downspouts are to be painted to match the surface to which they
are attached.
5.4.4 Vents, louvers, exposed flashing and service doors are to be painted consistent
with the exterior material of the building.
5.5 Screening. Areas used for loading, service access, ground -level mechanical
equipment, transformers and other appurtenant items that are of poor visual
quality and that are visible from contiguous parcels or streets are to be screened
by the use of the same, or compatible, material as the building exterior. In the
case of certain low-level items, such as transformers, the Grantor may approve
the substitution of dense, mature landscape materials. No Owner or Occupant
shall accumulate, maintain, store or allow to exist in, on or around the Property
any trash, garbage, waste disposal containers, or similar items outside of any
Building unless such items are screened from view at grade level by an opaque
fence constructed with the same, or compatible material as the building
exterior; provided however, that construction debris and waste disposal
containers may be maintained or stored on any part of the Property, if done in a
safe and secure manner, for so long as there is ongoing and continuous
construction on said part or portions of the Property, or in the case of an
Improvement, for so long as there is ongoing repair, restoration or remodeling
being undertaken. Notwithstanding the foregoing, no burning of rubbish or trash
shall be permitted at any time on any portion of the Property.
5.5.1 Screening of Roof Objects. Stand fans, skylights, air conditioning units, cooling
towers, elevator penthouses, vents, TV and other electronic and/or
communication aerials, towers, and devices, including microwave and other
types of "dishes", and any other structure or equipment which rises above the
roof line of any building or intended to be installed anywhere on any building site
outside of, or attached to, any building shall be architecturally compatible or
effectively shielded from view.
5.5.2 Screening of Open Storage. No storage of any articles, goods or materials shall
be permitted anywhere within said land outside of any building except with the
prior written approval of Grantor, who shall have the right, as a condition to any
such approval, to impose such limitations and screening requirements as it may
deem to be in the best interests of the area and the owners of portions of said
land. Any such approval may be revoked by Grantor if at any time any such
limitations or screening requirements are not complied with.
5.6 Signs: All signs will comply with the Little Rock Sign Ordinance.
5.6.1 All permanent signs shall have sizes, colors, lettering and arrangements that are
harmonious with the designs of the buildings they serve and the surrounding
landscape.
5.6.2 Signs may be illuminated provided that flashing, traveling, animated,
intermittent, pulsating, or rotating lamination shall not be used and that any
external lights be arranged so that the light source is shielded from view.
5.6.3 No sign located on the Property shall (a) be what is known as an advertising sign,
advertising business or products other than those sold, manufactured, or
warehoused at the Lot on which the sign is located; (b) be located on a rooftop.
5.6.4 No Owner shall install, or permit any tenant to install, any sign of any kind in the
street right of way.
5.7 Driveways and Parking
5.7.1 The location of curb cuts will be shown on the Final Plat of each Lot.
5.7.2 No parking shall be permitted on the streets within the Property.
5.7.3 Adequate off-street parking shall be provided by Owner for customers and
employees in conformance with the regulations of the City of Little Rock. No use
shall be made of any Lot within the Property or any building constructed thereon
which requires or is reasonably expected to require or attract parking in excess
of the parking capacity of the facilities maintained on said Lot.
5.7.4 No Owner or Occupant shall permanently or temporarily park or store in the
Common Area, or in any other portion of the Property, any boat, airplane
helicopter, house trailer, camper or recreational vehicle other than within a
building designed for that purpose and approved by Grantor.
5.7.5 Parking in the front yard space shall be limited to conventional passenger
vehicle such as automobiles, passenger vans, light trucks, motorcycles, bicycles,
or other vehicles reasonably required for the transportation of the Owners and
Occupants of the Property and their employees, agents and invitees it being the
intention of this section to prohibit both the parking of delivery vehicles and/or
the parking of any vehicle containing or exhibiting a permanent sign adjacent to
any contiguous street.
5.8 Lighting. All exterior lighting shall be shielded and directed away from adjoining
property owners.
5.9 Landscaping. Owner will be responsible for the design, development and
maintenance of the landscape on Owner's Lot and the contiguous planting
areas within the various rights -of -ways and public property to the edge of the
street pavement.
5.9.1 Parking Lots. The landscaped areas in the parking lots shall meet or exceed the
requirements of the City of Little Rock Landscape Ordinance.
5.9.2 Landscaping of certain parking areas. Where on -site parking area is provided in
the front yard space, the Owner shall plant and maintain, between the parking
areas and the street right-of-way, shrubbery which normally will grow to a
minimum height of five feet within one year of planting, in order to screen from
the street view the view of he parked vehicles. Landscaped berms are
encouraged for this purpose and where used, the total height of berm plus
landscaping shall also grow to a minimum of 5 ft. within one year of planting.
5.10 Noise Pollution. No activity which could cause a nuisance by reason of noise to
adjoining and/or surrounding property owners shall be permitted on any Lot. The
use and operation of an external public address system or paging system is
strictly prohibited.
5.11 Prohibited Uses. No lot shall be used for any purpose or business which is
considered dangerous or unsafe, or which constitutes a nuisance, or is noxious or
offensive by reason of dust, odor, gas, smoke, fumes or noise.
5.12 Building Heights. There shall be no restriction other than that contained within
the zoning ordinance of the City of Little Rock.
5.13 Utility Connections: All utility connections to the building shall be underground.
5.14 Fencing: No fencing shall be allowed in the front yard. The fencing to be used
shall be opaque and composed of materials which are compatible in style and
color the those materials used for the building.
ARTICLE 6: Termination, Modification, Enforcement and Assignments
6.1 Term. The covenants, conditions, restrictions and reservations contained herein
shall continue in full force and effect until January 1, 2055 and shall thereafter be
renewed automatically from year to year unless and until terminated as
provided in paragraph 6.2 hereof.
6.2 Termination and Modification. The covenants, conditions, restrictions and
reservations contained herein may be terminated, extended, modified or
amended so as to the whole of the Property or any portion thereof, with the
written consent of a minimum 66.67% of the owners of the lots within the Property.
Provided, however, none of the restrictive covenants herein contained may be
modified, terminated, amended, or canceled prior to January 1, 2030 without
the prior written consent of the Grantor, as long as Grantor owns any part of the
Property.
6.3 Right to Enforce. The restrictions and covenants and reservations herein set forth
run with the land and are binding upon the Grantor, the Owners and all parties,
persons and entities owning Property herein described, or any part thereof,
covenant and agree with all of the Owners of the Property hereby restricted and
with their heirs, successors, and assigns, and with each other, to conform to and
fully observe all of the covenants, restrictions, and reservations herein contained.
In furtherance of the above and foregoing, the Grantor and all Owners of any of
the Property hereby restricted shall have the right to sue for and obtain an
injunction, prohibitive or mandatory, to prevent breach of or to enforce the
observance of the covenants, restrictions and reservations herein set forth, in
addition to ordinary legal action for damages. The failure of the Grantor or any
Owner to enforce an of the covenants, restrictions or reservations herein
contained at the time of its violation, shall in no event be deemed a waiver of
the right to do so thereafter.
6.4 Assignment of Grantor's Rights and Duties. Any and all rights, power and
reservations of the Grantor herein contained may be assigned in good faith by
the Grantor to any responsible person, corporation or association or committee
who has a legitimate interest in the subject matter hereof, which will assume any
or all of the duties of Grantor hereunder, and upon any such person, corporation
or association's evidencing its consent in writing to accept such assignment, said
assignee shall, to the extent of such assignment, assume Grantor's duties
hereunder, have the same rights and powers and be subject to the same
obligations and duties as are given to and assumed by Grantor herein. Upon
such assignment, and to the extent thereof, the Grantor shall be relieved for all
liabilities, obligations and duties hereunder. If at any time the Grantor ceases to
exist and has not made such an assignment, a successor grantor may be
appointed by the Owners of 60% of the Property upon compliance with the
requirements of paragraph 6.2.
6.5 Additional Restrictions. The Grantor may include in any contract or deed
hereafter made and covering all or any part of the said land not yet conveyed
by the Grantor any additional covenants and restrictions applicable to the land
so conveyed which are not inconsistent with and which do not lower the
standards of the covenants and restrictions set forth herein.
ARTICLE 7: Miscellaneious
7.1 No waiver. All of the conditions, covenants, restrictions and reservations
contained in this DECLARTION OF COVENANTS AND RESTRICTIONS shall be
construed together, but if it shall at any time be held that any one of said
conditions, covenants, restrictions and reservations, or any part thereof is invalid,
or for any reason becomes unenforceable, no other conditions, covenants,
restrictions and reservations or any part thereof shall be thereby affected or
impaired.
7.2 Owner's Liability Subsequent to Sale. Upon the sale of a Lot, the Owner so selling
shall not have any further liability for the obligations thereon which accrue
against such Lot sold after the date of the conveyance; provided, however, that
nothing herein shall be construed so as to relieve an Owner of any parcel from
any liability or obligations incurred prior to such sale pursuant to this
DECLARATION OF COVENANTS AND RESTRICTIONS.
7.3 Benefits and Burdens. The terms and provisions contained in this DECLARATION
OF COVENANTS AND RESTRICTIONS shall bind and inure to the benefit of the
Grantor, the Owner, and their respective heirs, successors, personal
representatives and assigns.
7.4 Notice. Any notices required or permitted heren shall be in writing and mailed,
postage prepaid by registered or certified mail, return receipt requested, and
shall be directed as follows: If intended for an Owner, to the address supplied in
writing by the Owner to the Grantor, failing which the notice shall be sent to one
of the following, in the following order of priority: (1) to the Lot if improved; (2) if
the Lot is not improved, to the address set forth in the purchase contract; (3)
none of the foregoing, to the last known address of the Owner. If intended for
the Grantor, to the address as follows:

7.5 Singular and Plural. Words used herein, regardless of the number and gender
specifically used, shall be deemed and construed to include any other number,
singular or plural, and any other gender, masculine, feminine or neuter, as the
context requires.
7.6 Captions. The captions and headings used hereinabove are intended for
convenience of reference only, and shall not control or affect the meaning,
interpretation or construction of the various provisions.

Tamara, Entergy Arkansas, Inc. (Entergy) Transmission group has concerns mainly with encroachments and
developments within established easements. As long as future development of these lots on the plat do not interfere
