Relief from requirement to make any improvements-(e.q., dedicate
right-of-way and construct streets, provide water distribution and
sewer disposal system, etc.) in proposed subdivision.
STATEMENT OF PROPOSAL:
This applicant proposes a preliminary plat consisting of five
single family lots ranging in size from 1.158 acres to 2.275 acres.
The parcel is part of a "family settlement", and one of the lot to
be subdivided in this application contains the homesite of one the
applicants. The proposed access easement, which is delineated to
provide access to each of the lots, extends to and makes contact
with the dedicated right-of-way of Twyla Lane. The applicant
maintains that, since the parcel is a family settlement, there is
justification for waiving the requirements of the subdivision
ordinance, to construct streets and make other normal developer
provide improvements to the site thus the applicant asks for a
variance from these requirements.
A. PROPOSAL/REQUEST:
That the Planning Commission approve the preliminary plat
after granting a variance from the City Hoard of Directors for
any and all physical improvements on an access easement to be
provided and delineated in this filing.

engineering analysis that the lots will provide
adequate separation for private water sources and private
septic systems with absorption fields.
Provide information from the State Health Department that
private portable water systems are present in the
immediate vicinity of this land and that it can be
anticipated that these lots should be able to have
private water wells providing sufficient volume to supply
the required water for domestic use.
5. Provide drainage information, qualities, etc., both onto
and exiting the site.
E. ANALYSIS•
The Planning staff's view of this preliminary plat is that
there is at least one significant problem to be resolved prior
to the Planning Commission's action on this plat. The
decisive issue is adequate access to the site from a public
right-of-way. Unless additional land can be acquired to
provide a wider "beek" from Twyla Lane onto the site, then
there is inadequate access to this property.
The engineer has stated in his letter,of January 29, 1993 that
there are five residences on or bordering the site. All are
on septic systems and he has observed no septic leakage. He
feels that "the soil must perc fairly well". with the size of
the individual lots and since private sewer and water systems
are in use in the immediate area, it is anticipated that t_.a
requirements for engineering data to substantiate use of these
private systems can be provided.
Since the lots range in size from slightly over one acre t.c,
over two acres in size, and since the topography will remain
substantially unchanged, no insurmountable drainage problems
are anticipated. The method of intercepting and diverting
drainage leaving the site, specifically along the proposed
access easement (and whatever road bed is eventually built)
should be addressed. This engineering, as well as providing
the adjusted Arkansas Plane Coordinates, closure, and PAGIS
information are relative minor issues and should be easily
resolved.
The remaining question is that of the variance itself:
whether there should be placed on the developer no
requirement, to dedicate right-of-way or to construct streets
to city or even county standards.
