Box 990 Little Rock, AR 72203 REOUEST. This application proposes to gain approval from the Planning Commission for the release of a covenant restriction running with the title on this property. The covenant created with the original Parkway Place zoning and development plan, provides for an Architectural Review Committee. The Committee has not been active since its original creation by the City Board of Directors. There have been many instances of release of this instrument. The applicant has prepared the require instrument for recording at the County Court House which will be accomplished upon approval by the Planning Commission. STAFF REPORT: This type of application has been presented to the Commission in the past. The specifics here are that the covenants dealing with the Architectural Review Committee be lifted from the several lots within this plat. The staff has reviewed this item in the fashion of several lots preceding and has determined that there are no problems with removing the covenant. The staff has in hand the original of an amendment prepared by the developer and properly executed. This instrument will be recorded in the Pulaski County Court House to remove the specific offending paragraph from the original covenants. The staff recommends approval of this request. 1 SUBDIVISION ITEM ISO.: 19 Cont. - OTHER MATTERS SUBDIVISION COMMITTEE MEETING (January 31, 1991) Mr. Rett Tucker was present. There were no issues to discuss at this time. This item was forwarded to the full commission for the final -resolution. PLANNING COMMISSION ACTT ( February 12--, 19 91) There were no objectors in attendance. The application was represented. After a brief discussion, the Commission determined it appropriate to place this item on the consent agenda for approval. A motion was made to that effect and passed by a vote of 10 ayes, 0 nays, and 1 absent. 1 February 12, 1991 SUBDIVISION ITEM NO.: 20 - OTHER MATTERS LOCATION: Parkway West Commercial Subdivision DEVELOPER: Rett Tucker REQUEST• Rett Tucker, the Developer of Parkway West Commercial Subdivision, requests that the Planning Commission extend to this plat an approval of a standing plan to allow the sale of single lots in the small portion of the plat on a one lot basis. STAFF REPORT• The Planning Staff recommends approval of Mr. Tucker's request as filed. SUBDIVISION COMMITTEE MEETING (January 31, 1991) The subdivision committee discussed this item with applicant briefly. The planning staff pointed out that the ordinance provided for a staging plan on all preliminary plats and staff held to the five lot minimum only where a plan did not exist. PLANNING COMMISSION ACTION (February 12, 1991) There were no objectors in attendance. The application was represented. After a brief discussion, the Commission determined it appropriate to place this item on the consent agenda for approval. A motion was made to that effect and passed by a vote of 10 ayes, 0 nays, and 1 absent.
