VARIANCES REQUESTED:
1. All street improvements
A. PROPOSAL RE VEST:
The proposal consists of a one lot replat out of a part
of an adjacent lot. The plat as submitted is proposed for
residential use.
B. EXISTING CONDITIONS:
The site is currently undeveloped and fronts on Rainwood Road.
Right-of-way dedication of 5 feet for Rainwood Road will be
provided.
C. ENGINEERINGIUTILITY COMMENTS:
Collector right-of-way and improvements are required for
Rainwood Road.
Little Rock Waste Water Utility is requesting sewer main
extension with easements.
Little Rock Municipal Water Works is requesting a pro -rate
front footage charge of $8.50/foot applies along Rainwood Road
in addition to the normal connection fee.
Arkansas Power and Light is requesting several easements be
provided.

D. ISSUES LEGAL TECHNICAL ❑ESIGN:
The applicant has not submitted a revised plat showing the
relationship of both lots as of this writing. A variance to
permit omitting the balance of the ownership should be
requested if the owner feels compelled to pursue the current
submittal.
E. ANALYSIS:
The Planning staff's review of the plat has revealed several
problems with the project as presented. Further comment on
this plat cannot be given until a review of the revised replat
has been completed.
F. STAFF RECOMMENDATIONS:
Staff reserves comment or recommendation on the
preliminary/final. The request for waiver of street
improvements and inclusion of the balance of the ownership
will be commented on after additional review.
SUBDIVISION COMMITTEE COMMENT: (JULY 23, 1992)
The application was represented by Charlie Miller. Mr. Miller
explained in detail the request of his client. It was determined
that a revised replat would need to be submitted showing the
relationship of the two lots. No additional discussion took place.
PLANNING COMMISSION ACTION: (AUGUST 11, 1992)
Sherry Clawitter represented her family, the applicant. There were
no objectors in attendance. Ms. Clawitter stated that her mother
owns the entire property. She explained that there are three
daughters in the family and several years ago one-third of the
property was deeded to her in order to build a house. What they
would like to do is subdivide the property in order for all
daughters to have an equal amount of the property. Several years
ago the property owner of Pleasant Grove approached her and her
husband about closing the right-of-way behind their property, and
to close the street next to her mother's property to the east. At
that time, it was not known that her mother's property would gain
6 feet and 6 inches of additional property. Ms. Clawitter further
explained all they are wanting to do is change the property line.
Brady Walker, Subdivision Committee Chairman, stated that another
concern of the committee was the request for waiver of all street
improvements. This area is in bad need of street repair and all
the other developers had to meet the improvement requirement and
applicant should also.

A considerable amount of discussion continued regarding the
replatting, street improvements, one sister being on both
properties and the illegal with a quitclaim to deed transfer of
property the daughter.
A motion was then made to deny the applicant's request for a
preliminary final replat. The motion passed by a vote of 8 ayes,
2 nays and 1 absent.
