ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 31 OF
THE CODE OF ORDINANCES OF THE CITY OF
LITTLE ROCK, ARKANSAS PROVIDING FOR A
VARIANCE OF LOT DEPTH, STREET
IMPROVEMENTS AND SIDEWALK REQUIREMENTS
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That Chapter 31 of the Code of Ordinances be
amended to provide for variance of certain requirements within
the Subdivision Regulations of the City of Little Rock for Wolfe
Creek Subdivision Preliminary (S-950) as follows:
Subsection a. That the provisions of Section 31-232(B.H) be
amended to provide for a reduction in the minimum lot depth for
all 12 lots.
Subsection b. That the provisions of Section 31-397 be
amended to allow for a waiver from the requirements for street
improvements.
Subsection c. That the provisions of Section 31-402 be
amended to allow for no construction of sidewalks.
SECTION 2. This ordinance shall.take effect thirty (30)
days from and after its passage.

A. PROPOSAL/REQUEST:
This applicant proposes a preliminary plat in order to
construct a small subdivision located in Saline County.
Due to the fact that this site is located within the
extraterritorial subdivision area, the applicant has to apply
and meet the city's Subdivision Ordinance. The streets will
be constructed to Saline County specifications and will be
dedicated to Saline County.
B. EXISTING CONDITIONS:
A considerable amount of the land on which these 12 lots will
be located is within the 100 year floodway. Currently, this
site is undeveloped and covered with the natural foliage of
the area. There are no structures on the site.
C. ENGINEERING UTILITY COMMENTS:
Dedicate additional right-of-way on Shobe Road to meet
collector standard. Dedication of a floodway easement to
Saline County. Design and construct internal roads to meet
minimum subdivision standards.

Arkansas Power and Light is requesting that several easements
be provided.
D. ISSUESILEGAL/TECHNICALIDESIGN:
1. The applicant is requesting a variance to eliminate the
sidewalk requirements of the Subdivision Ordinance.
2. Also, the applicant is requesting a waiver of the
subdivision requirement, Section 31-232.B which states
"no residential lot shall be more than three (3) times as
deep as it is wide". This proposed subdivision will not
meet this requirement in order to utilize the land
located to the rear of the lots, which is in the 100 year
floodplain.
E. ANALYSIS•
The Planning staff's review of this preliminary plat reveals
that the plat can be developed, given the circumstances of
a large portion of the property, being in the f loodway.
The applicant has stated that the sewer disposal will be
provided by septic systems. The source of water supply will
be by wells.
F. STAFF RECOMMENDATIONS:
Staff recommends approval of the preliminary plat along with
the two waivers subject to the comments outlined by
Engineering.
SUBDIVISION COMMITTEE COMMENT:
(JULY 23, 1992)
The applicant was in attendance. Staff gave an overview of the
requested preliminary plat. The applicant indicated that the
Engineer of record had not performed a correct engineering survey
on the plat. The Chairman informed the applicant that a new
correct plat would have to be submitted by July 30, 1992 at
12:00 p.m. No other discussion took place.
PLANNING COMMISSION ACTION: (AUGUST 11, 1992)
Staff informed the Commission that this item was on the Consent
Agenda for approval conditioned upon a revised plat being
submitted. As part of the Consent Agenda, this item was approved
by a vote of 9 ayes, 0 nays and 2 absent per staff's
recommendation.
