REQUEST:
That the Little Rock Board of Directors provide a waiver/variance
from the sidewalk provision of Section 31-402 of the Code of
Ordinances (Subdivision Regulations) to permit the issuance of a
building permit for a bank canopy.
HISTORY•
This requests derives from a building permit review which
produced a request for construction of approximately 600 feet
of sidewalk. The cost of the sidewalks is estimated to cost
over ten (10) percent of the total bank remodel cost* which is
estimated at $46,000.
STAFF RECOMMENDATION:
That a variance be extended relative to this project as it is a
significant last minute add on. However, we feel the variance
should attach a condition that future construction on the site
of a cost and nature to support sidewalk should be cause for
installation. The ordinance submitted by staff with this agenda
provides for such a condition.
ORDINANCE NO.
AN ORDINANCE PROVIDING FOR A DEFERRAL
OF SIDEWALK IMPROVEMENTS REQUIRED BY
CHAPTER 31 OF THE CODE OF ORDINANCES
OF THE CITY OF LITTLE ROCK, ARKANSAS,
AS APPLIED TO LOTS 3 AND 4 UNIVERSITY
COMMERCIAL SUBDIVISION.
WHEREAS, the current owner of Lots 3 and 4 of
University Commercial Subdivision has made application for
a building permit on the said lots for the purpose of
construction of facilities for a drive-in bank.
WHEREAS, the City does not deem it necessary at the
present time for the owner to provide sidewalk improvements
to the lot area; and
WHEREAS, future development of the lots will require
the imposition of sidewalk improvements on the owner.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. That the construction of sidewalk
improvements under Little Rock Code Section 31-402 are
hereby deferred as applied to Lots 3 and 4 of the University
Commercial Subdivision.
SECTION 2. That the owner shall be required to
construct sidewalk improvements pursuant to ordinance
standards at such time in the future when the lots are
further developed or at such time that expansion of the
current buildings necessitates the imposition of sidewalk
improvements to these lots.
SECTION 3. This ordinance shall be filed in the deed
records of the Pulaski County Circuit Clerk.
SECTION 4. This ordinance shall take effect thirty
(30) days from_and after its passage.
