REOUEST:
This owner files this request to ask for a one-year time extension
to begin development work on the subdivision. The application
was originally approved by the Planning Commission on
February 25, 1992.
STAFF COMMENTIRECOMMENDATION:
Staff recommends approval of the application.
SUBDIVISION COMMITTEE COMMENT: (FEBRUARY 18, 1993)
This request was presented to the Committee and the Committee
recommended that the application be forwarded to the Commission for
approval.
PLANNING COMMISSION ACTION: (MARCH 9, 1993)
This item was recommended for inclusion in the Consent Agenda for
approval. When asked by the Chairman if any one was present at the
hearing who was opposed to any item on the Consent Agenda, no one
responded. In its approval of the Consent Agenda, this item was
approved with 9 ayes, 0 nays and 2 absent.

A. PROPOSAL RE ❑EST:
Single Family Residential
This proposal consists of a preliminary plat including
four single family lots with one point of access from
West Markham.
B. EXISTING CONDITIONS:
The existing terrain is intact with natural foliage. There
are apartment complexes to the west and single family to the
east side adjacent to the subdivision plat.
C. ENGINEERING COMMENTS:
The proposed private street should be a minimum of 24 feet
wide, designed and constructed to conform to Minor
Residential standards (ref: Section 31-207 of the
Subdivision Ordinance). west Markham Street is a minor
arterial, 45 feet from centerline minimum right-of-way
required. Dedication of 15 feet on the Markham frontage
is required. Stormwater detention and excavation
ordinances apply.

D. ISSUES LEGAL TECHNICAL DESIGN:
There are no legal, technical or design issues on the plat.
E. ANALYSIS•
The Planning staff finds no serious fault with the plat
subject to the resolution of the items pointed out by the
Engineering staff.
F. STAFF RECOMMENDATIONS:
Staff recommends approval of the plat subject to the
comments made by the Engineering,and Planning staff.
SUBDIVISION COMMITTEE COMMENT:
(FEBRUARY 6, 1992)
The application was represented by Joe White. Mr. White received
the checklist from the Planning staff that included all the
information to be placed on the plat as required by the
Ordinance. Mr. White agreed to make revisions to the preliminary
plat prior to the Planning Commission meeting. He also agreed to
comply with the Engineering staff's recommendation as stated
above in paragraph C.
There being no further discussion on the matter, this item was
forwarded to the Commission for final resolution.
PLANNING COMMISSION ACTION: (FEBRUARY 25, 1992)
The Planning staff offered its recommendation of approval of this
preliminary plat giving a brief background of the property.
Mr. Joe White, the engineer on the project, then addressed the
Commission answering questions concerning the lot sizes, Bill of
Assurance and access.
Tad Borkowski of the Planning staff added that the Bill of
Assurance calls for the houses to be a minimum of 1,600 square
feet.
The Chairman then asked for a person present whom was seeking
more information. Mr. Brad Henry representing the Wingate
Neighborhood was concern about the compatibility of the house
size and lots to the adjacent neighborhood.
Mr. Stephen Giles of the City Attorney's staff stated for the
record that the Planning Commission must approve a preliminary
plat as submitted in all instances where the plat is in complete
conformity with the ordinance standards.

A lengthy discussion of the proposal then followed with comments
from Mr. White, Mr. Brad Henry and several of the commissioners.
The result of this discussion was a determination that the plat
meets all ordinance standards and approval of this matter would
be in order. A motion was made to approve this application as
filed and passed by a vote of 10 ayes, 0 noes and 1 absent.
