A. PROPOSALLQUEST:
This owner proposes the replatting of an existing tract of
land, outside the city limits, into seven residential lots.
B. EXISTING CONDITIONS:
The existing land area is undisturbed at this time with
natural foliage in place. The street lying immediately to
the north, being Jennings Road, is a two-lane road with
ditches on both sides.
C. ENGINEERING COMMENTS:
No engineering objections to waiver of street improvements.
D. ISSUES LEGAL TECHNICAL DESIGN:
The only issues of significance for legal concern are the
requested waivers which will require the approval of the
City Board of Directors.

E. ANALYSIS•
The Planning staff's review of this replat finds very little
to comment on. Furthermore, the Planning staff will not
endorse commercial use for Lot 1 as stated in the Bill of
Assurance. Future annexation to the city will create
nonconforming use of the property, if developed
commercially.
F. STAFF RECOMMENDATIONS:
Staff recommends approval subject to the comments made
above.
SUBDIVISION COMMITTEE COMMENT:
(NOVEMBER 14, 19913
The applicant was present. -The Planning staff described the
preliminary plat and various elements of the proposal.
Richard Wood from Planning indicated that the owner of this plat
asked for the waivers of street improvements, drainage and
sidewalks. The Planning staff supports the waiver in keeping
with previous waivers requested for subdivision across the
street.
It was also explained that the City does not exercise zoning
outside its limits in this area and the statement in the Bill
of Assurance of Lot 1 being commercial does not commit commercial
use in the future.
The only remaining items for discussion were the phasing plan
and the Pulaski County request for additional easements. The
applicant agreed to place additional easement as requested by
the Pulaski County Planning Department. He also informed the
Committee that he would like to ask for a phasing plan as part
of the approval. He would like to plat four lots as the first
phase and three lots as the second phase.
There being no further discussion, the matter was forwarded to
the full Commission for resolution.
PLANNING COMMISSION ACTION:
(DECEMBER 3, 1991)
The owner, Ed Fryar, was present. There were no objectors. The
Planning staff recommended approval with a recommendation of
waivers approval.
Commissioner Nicholson raised some concerns over the staff's
recommendation of waiver approval. Jerry Gardner of Public
Works explained that this site is located 1.5 miles outside of

the city limits with no street improvements around. He also
stated the recommendation was based on the previous waivers
which have been approved in the past for this low income
neighborhood. Commissioner Nicholson suggested preparing
guidelines for waivers approval in the future. The planning
and engineering staff agreed to follow-up on that issue.
After a lengthy discussion, a motion was made to approve the
replat as filed. The motion passed by a vote of 9 ayes, 1 nay
and 1 absent.
