Waiver of street improvements 3.) Waiver of sidewalks A. PROPOSALjREOUEST: The proposal consists of a two lot replat out of a larger tract to separate the two uses; an automotive shop and a residential home. B. EXISTING CONDITIONS: The site is currently occupied by an auto repair garage on the Kanis frontage and single family residence on the back of the property. Kanis Road is a two-lane road with ditches on both sides. C. ISSUESILEGALITECHNICALIDESIGN: The staff has pointed out in item 1 on this agenda that there are several legal, technical and design concerns. These concerns are as follows: The staff firmly believes that sidewalks are an integral part of the neighborhood and should be included where required by Ordinance. The engineering staff calls for one-half of the minor arterial improvements along Kanis Road to meet Master Street Plan requirements. Our last point of concern is be moved to 25 feet from the confusion in the future. SUBDIVISION COMMITTEE COMMENTS: (JULY 18, 1991) Mr. Jones was present. The Planning Staff described the replat and presented their position on the attached waiver. The applicant stated that the staff's position on the waiver is a surprise for the owner and the applicant. Mr. Jones indicated that the price for the land could not justify improvements to Kanis Road. He also added that the owner does not object to the right-of-way dedication. There being no further items for discussion, the matter was forwarded to the Full Commission for resolution. F July 30, 1991 SUBDIVISION ITEM NO.: 2 (Continued) FILE NO.: S-926 PLANNING COMMISSION ACTION: (JULY 30, 1991) There were no objectors present. Staff recommended approval of the replat with a recommendation of denial for street improvements and sidewalk waivers. The attorney, Mr. Ken Jones, was present. Mr. Jones presented the application and displayed graphics of Kanis Road showing the existing businesses and road improvements. He stated that there are no improvements along Kanis Road from Chenal Parkway too. Commissioner Putnam supported the waiver for street improvements. Commissioner Perkins suggested deferring improvements until Mr. Brown decides to expand his existing business. Mr. Jerry Gardner from Public Works stated that there is no justification to waive the street improvements and sidewalks on Kanis Road. He also reminded the Commission that Aloha Pools located a half mile East on Kanis Road paid an in -lieu contribution for street improvements. Mr. Nick Farley, the pastor, from the Baptist church located directly East from the subject property, stated that they made an offer to purchase the property for future use as a residence and classroom. Mrs. Ruth Bell from the League of Women Voters stated that "Wildwood" located further west on Denny Road is expanding and planning a lot of activities that would stimulate a lot of traffic. Also, Ms. Bell stated that she would like to see Kanis Road be improved to Master Street standards. A general discussion then followed involving many of the points raised above. At the end of this discussion, a motion was made to approve the replat including a phasing plan to final one lot at a time, with deferral of street improvements until the final plat is filed. The right-of-way dedication on all 210 feet frontage and in -lieu contributions for improvements for 32 feet of Lot 23-B to be accomplished with Phase I. The motion passed by a vote of 7 ayes, 0 nays and 4 absent. 3
