Drainage A. PROPOSALIREOUEST: This proposal consists of a two lot replat out of a larger lot. The plat, as submitted, is proposed for residential usage. B. EXISTING CONDITIONS: The site is currently occupied by one residential home. The street is developed to the county standards with 20 feet of asphalt and ditches on both sides. C. ENGINEERING COMMENTS UTILITY COMMENTS: There are no engineering comments or objections for the waivers requested. D. ISSUES LEGAL TECHNICAL DESIGN: There are two issues associated with this replat: 1. Written consent from Spring Valley Realty Company, Inc. to allow subdivision. 2. The Arkansas Health Department's approval for the additional sewer connection. 1 October 22, 1991 SUBDIVISION ITEM NO.: 1 Continued FILE NO.: S-926-A E. ANALYSIS• The Planning Staff's review of this replat finds little to comment on. The applicant needs to provide written consent from Spring Valley Realty Company, Inc. as stated in the Bill of Assurance and the Arkansas Health Department's approval for the additional connection to the private sewer system. F. STAFF RECOMMENDATIONS: Staff recommends the approval of this replat subject to the applicant providing written consent from Spring Valley Realty Company, Inc. and the Arkansas Health Department's approval. Further, the waivers will be granted as requested and forwarded to the City Board of Directors. SUBDIVISION COMMITTEE COMMENT: (OCTOBER 3, 1991) The applicant was present. The staff's recommendation was discussed. Mr. McGetrick indicated that he will provide a written consent from Spring Valley Realty Company and the Arkansas Health Department before the Planning Commission meeting. There were no significant issues to relate to the full Commission. The item was forwarded without further comments. PLANNING COMMISSION ACTION: (OCTOBER 22, 1991) The owner and engineer, Mr. McGetrick, were present. Mr. McGetrick offered an overview of his client's request indicating that no new lots were being created. He stated the two lots have existed since the late 19601s. Only one new building site will be created since a residence exists on the other lot. A lengthy discussion followed and staff pointed out there was a letter of objection from a neighbor. The objector, Mrs. Mikes, presented her thoughts, which the Bill of Assurance requires approval from the property owners before replatting. Another lengthy discussion was held involving staff and the Commission on whether the Bill of Assurance enforcement was their responsibility. The consensus was whether it should be reviewed, but not be the determining factor in the Commission's action. Additional items of information were introduced to support both sides of the matter, however were found to be inconclusive. 2 October 22, 1991 SUBDIVISION ITEM NO.: 1 Continued FILE NO.: S-926-A A motion was made to approve the replat as requested. It was recommended that the City Board of Directors grant a variance from the street improvements, sidewalk and drainage as requested.
