A. PROPOSAL RE UEST:
This proposal is for a two -lot preliminary/final plat
providing for the development of one tract as a single
family site and the remaining parcel to accommodate
existing single family house.
B. EXISTING CONDITIONS:
This site currently is occupied by a single family
house and storage building the adjacent street, Raines
Road, is 24 ft. wide asphalt with ditches on both
sides.
C. ENGINEERING COMMENTS:
Engineering does not object to the requested waiver of
street improvements. Provide additional right-of-way
on Raines Road (45' from c/1).

D. ISSUES LEGAL TECHNICAL DESIGN:
The only issue of consequence relative to technical
concern is the pagis monuments requirements which have
been requested to be waived. The Engineering
andPlanning staff located two pagis monuments in a
closed neighborhood to the subject property (monument
#2081 of Raines Road and monument #2068 of Crystal
Valley Road close to Raines Road) which would be use to
set two additional monuments along Ida Loring's
subdivision. It should be noted for the record that
the engineering and Planning staff oppose the pagis
requirements waiver. The City would like to encourage
private developers' to place pagis monuments for
greater accuracy and future benefits to property
owners.
E. ANALYSIS•
The planning staff finds no serious fault with the
plat, subject; however, to resolve the items pointed
out above.
F. STAFF RECOMMENDATION:
Staff recommends approval of the Preliminary/Final
Plat, subject to minor modifications.
SUBDIVISION COMMITTEE COMMENT (APRIL 25, 1991)
Mr. Charlie Miller was present representing the application.
He indicated that this plat consists of only two lots and
does not require Pagis Monuments according to the amended
Ordinance #15,929. He pointed out that his client is
willing to dedicate right-of-way but still would like to ask
for a street improvements waiver.
The Engineer and Planning Staff agreed to dismiss Pagis
Monument requirement. It was also added that street
improvements need to be addressed again at the full
Commission and sent to the Board of Directors for final
approval. There being no further items for discussion the
matter was forwarded to the full Commission for resolution.

PLANNING COMMISSION ACTION (May 7, 1991)
The Planning Staff reported to the Commission that the
applicant had failed to send notices to the adjacent
property owners 15 days before the meeting as required by
Bylaw, however Staff recommends conditional approval of the
Preliminary/Final Plat if the Planning Commission agrees to
waive the Bylaw requirement. The Planning Staff also agreed
to report to the Commission and reset for public hearing if
any calls are received in opposition before the Board of
Directors meeting on June 4th -
Commissioner McDaniel pointed out the importance of the
notice. Commissioner Oleson requested that Staff monitors
Pagis Monuments requirement if the owner attempts to
subdivide again and create more than four lots which would
require placement of the Pagis Monuments.
The motion was then made to suspend the Bylaw requirement as
recommended by Staff. The motion passed by a vote of 6
ayes, 1 nays, 3 absent and one open position. The second
motion was made to approve preliminary/final plat with
recommendation of waiver approval. The motion passed by a
vote of 6 ayes, 0 nays, 1 abstain, 3 absent and one open
position.
