PLAT AND BILL OF ASSURANCE
TO THE PUBLIC:
WHEREAS, Grantor, TCBY Enterprises, Inc., a Delaware corporation
qualified to do business in the state of Arkansas, is the owner of
the following described land lying in Pulaski County, Arkansas, to
wit:
PART OF THE NORTH 1/2 OF THE SW1/4 OF SECTION 16,
TOWNSHIP 1 NORTH, RANGE 11 WEST OF THE FIFTH PRINCIPAL
MERIDIAN, CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS,
DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHWEST CORNER OF TRACT L, AREA 201,
LITTLE ROCK INDUSTRIAL PARK AS DESCRIBED AND PLATTED PER
PLAT BOOK A, PG 739, A FOUND 5/8" IRON ROD BEING ON THE
NORTH RIGHT-OF-WAY LINE OF LINDSEY ROAD; THENCE
S89°47108"E, ALONG SAID RIGHT-OF-WAY, FOR 701.34 FEET TO
THE SOUTHEAST CORNER OF TRACT 0, AREA 201, LITTLE ROCK
PORT INDUSTRIAL PARK AS PLATTED PER PLAT BOOK A, PG 739,
A FOUND 1/2" ROD; THENCE ALONG THE NORTHWESTERN RIGHT-
OF-WAY LINE OF A LITTLE ROCK PORT AUTHORITY RAILROAD
SPUR, BEING A NON -TANGENT CURVE CONCAVE TO THE SOUTHEAST,
SAID CURVE HAVING A RADIUS OF 423.07 FEET AND A CHORD
BEARING AND DISTANCE OF N39°55'08"E, 376.84' TO THE SOUTH
LINE OF THE LITTLE ROCK PORT AUTHORITY RAILROAD
MARSHALING YARD RIGHT-OF-WAY, A FOUND 1/2" IRON ROD;
THENCE N890471081-W, ALONG SAID MARSHALING YARD RIGHT-OF-
WAY, FOR 1247.39 FEET TO A FOUND 1/2" ROD; THENCE ALONG
THE NORTHEASTERN RIGHT-OF-WAY LINE OF A LITTLE ROCK PORT
AUTHORITY RAILROAD SPUR, BEING A NON -TANGENT CURVE
CONCAVE TO THE SOUTHWEST, SAID CURVE HAVING A RADIUS OF
559.44 FEET AND A CHORD BEARING AND DISTANCE OF
S46°15'58"E, 420.99' TO THE POINT OF BEGINNING, AND
CONTAINING 5.96 ACRES MORE OR LESS.
AND, WHEREAS, Grantor deems it desireable that the above property
be now combined into one lot as shown on the attached Plat and be
held, owned and conveyed, as replatted;
NOW, THEREFORE, Grantor for and in consideration of the benefits
to accrue to it, which benefits it acknowledges to be of value, has
caused to be made the Plat hereto attached showing survey made
September 25, 1989, signed by Dan B. Robison, Registered Land
Surveyor, and James McClelland, Jr., Registered Engineer, and
bearing a Certificate of Approval executed by the Little Rock
Planning Commission and showing the bounds and dimensions of the
property now being replatted.

There are also shown on said Plat certain easements which Grantor
hereby donates and dedicates to and for the use of public
utilities, the same being, without limiting the generality of the
foregoing, electric power, gas, telephone, water and sewer, with
the right hereby granted to the persons, firms or corporations
engaged in supplying such utility services to use and occupy such
easements and to have free ingress and egress therefrom for the
installation, maintenance, repair and replacement of such utility
service. Filing of this Plat and Bill of Assurance for record in
the office of the Circuit Clerk and Recorder of Pulaski County,
Arkansas, will be a valid and complete dedication of the aforesaid
easements.
The land embraced in said Plat shall be forever known as "Lot 1 of
Riverport Replat, Little Rock Port Industrial Park to the City of
Little Rock, Arkansas", and any and every Deed of Conveyance
describing the property as shown on said Plat shall be deemed a
sufficient description thereof.
Said property herein replatted and any interest therein, shall be
held, owned and conveyed subject to and in conformity with the
covenants and restrictions contained in that certain Bill of
Assurance filed for record by the city of Little Rock, Arkansas,
as Grantor, on December 16, 1971, in the office of the Circuit
Clerk and Recorder of Pulaski County, Arkansas, and appearing of
record in Book 1175 at Page 543, as amended.
IN WITNESS WHEREOF, the said Grantor has hereunto affixed its seal
and caused these presents to be executed by its duly authorized

Re: RIVERPORT REPLAT
Dear Richard:
Per our meeting of August 21, 1989, and Chapter 31 of the Little Rock City
Code, please accept this letter as a request for review and approval of the
RIVERPORT REPLAT and Bill of Assurance.
As you know, this replat simply combines Tracts L, N, & 0 of Area 201 of the
Little Rock Port Industrial Park. It will extinguish the utility easements and
the platted building lines between said Tracts L, N, & 0. As you requested, I
contacted the water, gas, electric and sewer utilities asking for comments on
the replat. No adverse comments were received.
I would be happy to answer any further questions you or your staff might have
with respect to this request.
