A. PROPOSAL/REQUEST:
This plat is filed as a mixed use preliminary plat for
office and commercial activity. The parcel is outside
the City limits at this time and beyond land use
regulation.
B. EXISTING CONDITIONS:
This property is occupied by one residence. The
eastern lot of the plat is being prepared for
development as a pool company sales lot.
C. ENGINEERING COMMENTS:
The owner should provide right-of-way and improvements
on Kanis Road to minor arterial standards.

D. ISSUES/LEGAL/TECHNICAL/DESIGN:
There are a number of plat elements missing on this
preliminary plat. These include the source of title
and book and page on the ownership, an acreage figure,
and clarification of the access easement in the Bill of
Assurance. The owner should be aware that approval of
this plat does not commit the City to rezone the lot
when extraterritorial zoning is enacted.
E. ANALYSIS:
The Planning Staff finds little issue with this plat.
It is well drafted and has few deficiencies.
F. STAFF RECOMMENDATION:
Staff recommends approval of the plat subject to the
several minor modifications.
SUBDIVISION COMMITTEE COMMENT: (July 27, 1989)
Mr. Pat McGetrick was present representing this preliminary
plat. Mr. McGetrick indicated that the staff recommendation
presented no problem. He pointed out that the drainage
structure beneath Kanis Road presents a problem with respect
to performing the required street improvements. He
indicated that this structure was a double (10, x 101)
drainage box. He indicated that it would need to be
lengthened. Jerry Gardner of the Public Work Department
supported that information.
The discussion then moved to the appropriate means to
address improvements of this nature. Staff indicated that
it might be appropriate to address this improvement with the
in lieu contribution in place of actual construction. In
doing so, the City would at some later date contribute the
public share of building the large drainage structure.
The only remaining items for discussion were the several
minor plat details pointed out by Staff. Mr. McGetrick
indicated he would follow through on those items.
There being no further discussion, the matter was forwarded
to the full Commission for resolution.

PLANNING COMMISSION ACTION:
(August 8, 1989)
The applicant was represented. After a brief discussion,
the Commission determined it appropriate to place this item
on the consent agenda for approval subject to in -lieu
contribution for Kanis Road improvements except for the
large drainage structure. A motion to that effect was made.
The motion passed by a vote 7 ayes, 0 noes, 4 absent.
