Mathis and Nina Mathis, his wife, (herei after referred to collectively as "Declarant"). WHEREAS, Declarant is the sole owner of the property, more particularly described on Exhibit "A", attached hereto and by this reference incorporated herein word-for-word, all of which property lies in the County of Pulaski, State of Arkansas, and it is deemed desirable that said property be now replatted, and that the property be held, owned and conveyed subject to the covenants and easements herein contained; NOW, THEREFORE, the Declarant, for and in consideration of the benefits to accrue, which benefits Declarant acknowledges to be of value, has caused to be made a plat, hereto attached showing surveys made February 14, 1989, signed by Timothy E. Datears, Registered Engineer, and said Declarant, which plat is identified by the title M.G.M. Subdivision and the date February 14, 1989, and bears a certificate of approval executed by the Little Rock Planning Commission, and is recorded simultaneously herewith at Platbook , Page of the records of the Recorder of Pulaski County, Arkansas, said plat being fully incorporated herein by referenced (as now or hereafter amended, the "Plat"), and showing the boundaries and dimensions of the- property now being replatted, and the Declarant does hereby make this Bill of Assurance. The Grantor does hereby certify that said property has been replatted in accordance with said Plat. The property embraced in said Plat shall be forever known as "M.G.M. Subdivision to the City of Little Rock", and any and every deed of conveyance for any of said property shall use this designation. The filing of this Billetiof Assurance and Plat for record in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, will be a valid and complete delivery and dedication of the streets and easements shown on the said Plat, subject to any limitations herein set out. The land herein platted and any interest therein shall be held, owned and conveyed subject to and in conformity with the following covenants which, subject to being amended or cancelled as hereinafter provided, shall be -perpetual, shall be and remain in full force and effect for a period of thirty (30) years from the date of recordation hereof, to wit: 41 1. Land Use. Lots 1 and 2 herein platted shall be held, owned and used for commercial purposes. However, nothing contained herein shall prohibit any occupation or activity in any building which is otherwise permitted by the Building Code and Zoning Ordinance of the City of Little Rock, Arkansas. 2. Building TY22. All buildings constructed on said Lots shall be constructed no nearer to the street than the building line shown on the Plat, and all buildings shall be constructed in conformance with the Building Code and Zoning Ordinance of the City of Little Rock, Arkansas. 3. Nuisance. Neither building site shall be used for any purpose or business which is dangerous or unsafe, or which constitutes a nuisance. 4. Amendment. Any and all of the covenants, provisions or restrictions set forth in this Bill of Assurance may be amended, modified, extended, changed or cancelled, in whole or in part, by a written instrument signed and acknowledged by the owner or owners of over fifty percent (50%) in area of the land in this Subdivision and the provisions of such instrument so executed shall be binding from and after the date it is duly filed for record in Pulaski County, Arkansas.
