3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID; TO AUTHORIZE TILE CITY MANAGER TO DISPENSE WITH
5 THE REQUIREMENT OF COMPETITIVE BIDDING AND ENTER INTO
6 A SOLE-SOURCE CONTRACT WITH TYLER TECHNOLOGIES, INC.,
7 IN AN AMOUNT NOT TO EXCEED ONE HUNDRED AND SEVEN THOU-
8 SAND, EIGHT HUNDRED THIRTY-SEVEN AND 60/100 DOLLARS
9 ($107,837.60), PLUS APPLICABLE TAXES AND FEES, FOR THE AN-
10 NUAL SOFTWARE SUBSCRIPTION AND MAINTENANCE RENEWAL;
11 AND FOR OTHER PURPOSES.

13 WHEREAS,Tyler Technologies,Inc., is the City's current Open Data Platform vendor; and,
14 WHEREAS,the Open Performance Module connects with the data sets on the City's current Open
15 Data Platform and is an extension of the work that has been done with What Works Cities;and,
16 WHEREAS, competitive bidding should be waived and a contract awarded to Tyler Technologies,
17 Inc.,as the sole-source provider for the renewal of the Annual Software Subscription and Maintenance.
18 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
19 OF LITTLE ROCK,ARKANSAS:
20 Section 1. The Board of Directors fmds that competitive bidding should be dispensed with regarding
21 the renewal of the Annual Software Subscription and Maintenance,and the contract for such services should
22 be awarded to Tyler Technologies,Inc.,as the sole-source provider for these services.
23 Section 2. The City Manager is hereby authorized to dispense with competitive bidding and is
24 authorized to enter into a renewal contract with Socrata, Inc., for the Annual Software Subscription and
25 Maintenance Contract in an amount not to exceed One Hundred and Seven Thousand, Eight Hundred
26 Thirty-Seven and 60/100 Dollars($107,837.60),plus applicable taxes and fees.The current contract termi-
27 nated on May 1,2024,and if approved,the current renewal contract has an effective date of May 2, 2024.
28 Section 3. Funding for this purchase is available from Account No. 101011-61330.
29 Section 4.Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
30 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
31 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
32 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
33 ordinance.

1 Section 5. Repealer. All laws,ordinances,resolutions,or parts of the same,that are inconsistent with
2 the provisions of this ordinance,are hereby repealed to the extent of such inconsistency.
