Re: New Water Service at 12602 Brown Road,
Little Rock, Arkansas 72206
Dear Mr. Wood:
Three weeks ago my husband and I applied for new
water service and a water meter at the above -referenced
address with the Little Rock Municipal Water Works Company.
We were notified last Thursday that our request had been
denied by the Little Rock Planning Commission because we are
in violation of Little Rock subdivision regulations.
We hereby request reconsideration of this decision.
The following is a brief history concerning our property.
Approximately ten years ago my husband and his
brother jointly purchased a one acre tract of land with
frontage on Brown Road. We are outside the city limits. When
my brother-in-law built his home in 1983, he was required by
the bank that advanced his construction loan to have the one
acre tract divided in half so that his one-half acre could be
mortgaged. A survey was performed and the one acre tract was
divided into two one-half acre tracts, with each of us
receiving a warranty deed to our respective half acres. Our
one-half acre is on the west side of Brown Road on the North
end. My brother-in-law's half acre is on the South end, which
contains a 12 foot easement.
We have been advised that our property must be
platted before we can receive a water meter. We respectfully
request that the plat requirement be waived in our case and
that we receive water service from the Little Rock Municipal
Water Works Company.

We feel that the plat requirement should be waived as
we have frontage on Brown Road, said road having a water main
running the length of it.
At this time there is already an existing meter,
belonging to a neighbor, in our front yard and a second meter
could easily be placed in the same box.
There are no legal disputes which could arise over
legal access to our property as we have no easements,
right-of-ways, etc. on our property. Our property fronts
Brown Road.
We respectfully request that the Little Rock Planning
Commission take this matter under advisement and ultimately
waive the plat requirement in this case, thus allowing us to
receive water service to our property.

FOR SECTIONS 37.18 AND 37.21 CALLING FOR
A WAIVER OF ALL SUBDIVISION REQUIREMENTS
WHEREAS, the Little Rock Planning Commission has
reviewed the request Jeff and Tracy Thompson on property
described as:
12602 Brown Road, Little Rock, Arkansas 72206
WHEREAS, a waiver from certain requirements of the
Subdivision Ordinance has been requested by the subdivider;
and
WHEREAS, the Little Rock Board of Directors has
determined that the waiver request conforms to the waiver
requirements stated in Section 37-10 of the Subdivision
Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. A waiver of Section 37.18 and 37.21 of the
Subdivision Code of Ordinances of the City of Little Rock
pertaining to application and design requirements is hereby
granted for the described property.
