BiLL OF ASSURANCE
KNOW ALL NME1 BY THESE PRESENTS:
THAT, WHEREAS, a Bill of Assurance for the Belle Pointe Subdixision to the
City of Little Rock, Arkansas, ("Belle Pointe") was executed on the 12th day of
September, 1989 and filed of record in the office of the Circuit Clerk and Ex-
Officio Recorder of Pulaski County, Arkansas, as document number 89-50028, in
Plat Book C, Page 853, the 19th day of September, 1989 (the "Original Bill of
Assurance"); and
WHEREAS, an Amended and Restated Bill of Assurance for the Belle Pointe
Subdivision to the City of Little Rock, Arkansas, ("Belle Pointe") was executed on
the 8th day of November, 1993 and filed of record in the office of the Circuit Clerk
and Ex-Officio Recorder of Pulaski County, Arkansas, as document number 93-
78187, in Plat Book D, Page 849 the l2th day of November, 1993 (the "First
Amended Bill of .Assurance"); and
WHEREAS, Belle Pointe is comprised of the real property described on Exhibit
'A' attached hereto and incorporated herein by reference (the "Property"); and
WHEREAS, by a Plat filed of record as document number 89-50028, filed for
record on Septemmber 19, 1989, in Plat Book C, Page 8S3, in the office of the Circuit
Clerk and Ex-Officio Recorder of Pulaski County, Arkansas (the "Original Plat"), the
Property was subdivided into Thirty-tcwo (32) numbered Lots and a Tract 'A' and a
Tract 'B'; and
WHEREAS, by a Plat filed of record as document number 93-78187, filed for
record on November 17, 1993, in Plat Book D, Page i49, in the office of the Circuit
Clerk and Ex-Officio Recorder of Pulaski County, Arkansas (tile "First Amended
Plat"), the Property was subdivided into Forty (40) numbered Lots and a Tract 'A'
and a Tract W; and
WHEREAS, the undersigned, Carriage Creek Property Owners' Improvement
District No. 639 of Little Rock, Arkansas, a municipal property owners'
improvement district created pursuant to Act 113 of the Acts of Arkansas (the
"District"), being the owner of more than Seventy -Five percent (75%) of the total lots
contained in the First Amended Plat for Belle Pointe; and
WHEREAS, The undersigned are desirous of amending the final plant of said
Belle Pointe Addition, being the First Amended Plat as hereinabove described, for
the purpose of replatting Lots 1 R through GR and including the propeAy formerly
known as Lots 35 through 38 of Pleasant Heights Addition, Phases 1 and 2 within
the subdivision.
NOW, THEREFORE, the undersigned, for and in consideration of the benefits
to accrue to it, its successors and assigns, which benefits it acknowledges to be of
value, has caused to be made the Plat entitled "Plat of Lots 1 RR-GRR Belle Pointe
an Addition to the City of Little Rock, Arkansas, showing a survey by Paul White,
Registered Land Surveyor, dated the ___ day of --------- 1996, and bearing a
Certificate of Approval executed by the Little Rock Planning Commission, and
showing the bounds and dimensions of the portion of the Property now being
resubdivided into lots and streets (the "Plat").
The lands in said Plat shall be forever known as Lots I RR through 6RR, Belle
Pointe, an addition to the City of Little Rock, .Arkansas and any and every deed of
conveyance of any lot in such addition describing the sarne by the number shown
on said Plat shall always be deemed a sufficient description thereof.
The Property and any interest therein shall be held, owned and conveyed
subject to and in conformity "ith the covenants contained in the First Amended
Bill of Assurance hereinabove describe, as the same shall be amended from time
to time.
