AMENDED BILL OF ASSURANCE:I
KNOW ALL MEN BY THESE PRESENTS: r`Y'r;, ,; •.r '--'..:
WHEREAS, Carole Baker is the sole owner of the real property located in Little Rock,
Pulaski County, Arkansas, described on Schedule A attached hereto and made a part hereof
(the "Real Property"); and
WHEREAS, it is desirable that the Real Property be subdivided into lots, tracts and
easements for access;
NOW, THEREFORE, WITNESSETH: P)Q,4- t� 2 0IS 0 -7 _7 /Z
Carole Baker, as "Grantor", has caused the Real Property to be surveyed by W.
William Graham, Jr., a Registered Professional Engineer, and a plat thereof made which is
identified by the title Lots 1 and 2, Carole's Addition, dated _ , and by the
signature of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, in Plat Book
Page , and the Grantor does hereby make this Bill of Assurance.
AND, the Grantor hereby certifies that she has laid off, platted and subdivided, and
does hereby lay off, plat and subdivide, said real estate in accordance with said plat. The
lands embraced in said plat shall be forever know as Carole's Addition, as designed on said
plat; and every deed of conveyance for said Real Property shall use this designation.
The Grantor hereby dedicates an Underground Utility and Access Easement shown by
said plat, to be used for access and underground utilities.
There are strips of ground shown and dimensioned on said plat marked "Utility
Easement", "Underground Utility and Access Easement" and "Drainage Easement"
(collectively, "Easements") reserved for the use of public utilities, and for drainage purposes
respectively, subject at all times to the proper authorities and to the easement herein reserved.
Owners of lots in this subdivision shall take their titles subject to the rights of public utilities
and the public.
The filing of this Bill of Assurance and plat for record in the office of the Circuit Clerk
and Ex-Officio Recorder of Pulaski County shall be a valid and complete delivery and
dedication of the easements shown on said Plat.
Hereafter, conveyance and description of any of said lands by lot number as shown on
said plat shall be a proper and sufficient description thereof.
The lots in said subdivision shall be sold by the Grantor and shall be purchased by the
buyers thereof, subject to the following covenants, to wit:
1. No permanent structure shall be built or maintained within the area of any of
the easements shown on the plat, and in the event any such structure is placed thereon in
violation of those restrictions and reservations, no utility and/or public agent will be liable for
destruction of same in constructing and maintaining its facilities located within the area of
said easement.
2. If Lot 1 is sold to a Buyer that intends to construct a motel or hotel thereon,
then no motel, hotel, resort, lodge, motor inn, or any other structure or building for temporary
or semi -permanent lodging may be constructed or operated on Lot 2 for a period of thirty
years fiom the date that Lot 1 is sold to a buyer that purchased Lot 1 with intent to construct
such a structure on Lot 1, after which time said restriction shall be automatically extended for
successive periods of ten years, unless an instrument signed by a majority of the then owners
of the lots has been recorded agreeing to change said restriction in whole or in part.. After
sale of Lot 1 to a Buyer whose intended use is within the terms of this Paragraph 2, then the
Grantor, her successors and assigns, shall include a reference to this restriction on use in any
conveyance of all or any part of Lot 2; provided, however, failure to mention this restriction
on use in any conveyance document shall not affect the enforceability of this restriction.
3. In addition to the restrictions set forth in preceding paragraph, the following
businesses, uses and activities are expressly prohibited in Carole's Addition:
a. Uses that create a public or private nuisance, including uses which allow any
dumping, disposing, recycling, incineration of refuse or recyclables, and/or result in
undue noise, sound, vibration, litter or odor;

b. Uses that allow auction or other sales, including bankruptcy, fire, distress,
liquidation, sheriffs or receivers' sale to be conducted on or from Lots;
C. Operation of a massage parlor or bath house, adult book or adult video store or
the sale or exhibition of pornographic material or display;
d. Operation of a funeral parlor or mortuary;
e. Operation of Mobile home, trailer or RV Court;
f. Off-track betting business, bingo, lottery or similar games of chance sales or
facility;
h. Operation of an Astrology, palm reading, tarot card or other like service or
facility; and/or
Operation of a Drug paraphernalia shop.
4. The covenants and restrictions set forth herein are the only restrictions on use
of the Lots in Carole's Addition and Lot 2 may be used for any other permitted use authorized
by its C-4 zoning classification. These covenants and restrictions are also intended to run
with the land and shall be binding on all parties and all persons claiming under them, for a
period of thirty years from the date these covenants and restrictions are recorded, after which
time said covenants and restrictions shall be automatically extended for successive periods of
ten years, unless an instrument signed by a majority of the then owners of the lots has been
recorded, agreeing to change said covenants and restrictions in whole or in part.
5. The covenants and restrictions shall not be amended, cancelled or
supplemented unless an instrument signed by at least sixty percent (60%) of the owners of the
aforesaid lots is placed on record agreeing to change the covenants and restriction in whole or
in part, and any change must be approved by the Little Rock Planning Commission.
6. In the event of any attempt to violate any of the covenants or restrictions herein
before the expiration date hereof, it shall be lawful for any person or persons owning a lot or
lots in said addition to prosecute any proceedings at law or in equity against the person or
persons violating or attempting to violate any such covenant or restrictions, and either to
prevent him or them from so doing or to recover damages or other dues for such violations.
7. All buildings constructed on said lots shall be constructed no nearer to the
street than the building line shown on the Plat, and all buildings shall be constructed in

conformance with the Building Code and Zoning Ordinance of the City of Little Rock,
Arkansas.
8. This Amended Bill of Assurance replaces any prior Bill of Assurance, if any,
that may have been applicable to the Real Property.
9. The invalidation of any one of these covenants or restrictions by judgment or
court order shall in no way affect any of the other provisions, which shall remain in full force
and effect.
The consideration set forth in items 1 through 9 are hereby approved by the City of
Little Rock Planning Commission. Any additional requirements, restrictions or statements are
entered without review or action by the Planning Commission, and shall not be considered
part of the Little Rock Planning Commission's requirements for plat approval.

Dear Mr. Graham:
Little Rock Wastewater has reviewed the above referenced plans. They are approved
as submitted with one (1) copy being returned to you for your files with this letter.
Approval is being granted to the applicant to construct and install a sewer main
extension. The applicant shall be responsible for all costs associated with the
installation of the sewer main extension in order to obtain wastewater service from
the Little Rock Wastewater (LRW). Please be advised that this approval is based on the
following standard and special conditions:
1. All significant changes in the plans for the proposed construction must be approved
prior to construction and all construction shall comply with the applicable
requirements and specifications of the latest addition of the Little Rock
Wastewater Standard Specifications For Sewer Construction In The City of
Little Rock.
2. Continuous project responsibility by the engineer is an express condition of this
plan approval. Reference is made to Part 4 of Section 01100 Standard Specifications
For Sewer Construction In The City of Little Rock.
3. The name of the Resident Inspector shall be furnished to LRW prior to the start of
construction. No construction may begin until this Approval Letter is
acknowledged by the Applicant (Owner) and returned to Little Rock
Wastewater along with all applicable charges shown on Page 3 of this
Approval Letter.
4. This approval letter shall be in force for a period of one (1) year. If construction of
the project has not begun within the one year period, LRW's approval of the project
will expire. No fees paid to the Little Rock Wastewater for this project shall be
reimbursed should the project approval expire.
5. Sanitary sewer lines shall be kept a minimum horizontal distance of 5' from all
underground utilities (Including Storm Drainage) except water lines, which shall be
kept a minimum distance of 10' from sanitary sewer lines.

6. Connection of the proposed sewer main to the existing sewer main shall not
be made until the proposed sewer main has been tested, inspected, and
accepted by the Little Rock Wastewater. The applicant shall convey title to the
sewer main extension together with all necessary easements, free and clear of
all liens and encumbrances, by the appropriate documents. All Final
Paperwork must be submitted to LRW prior to the connection of the proposed
sewer mains being made.
7. Ductile Iron Pipe shall be used on this project as shown on plans and any time the
cover to the existing or proposed ground is less than thirty inches (30") or where
clearance between two pipes is less than eighteen inches (18"). It shall be the
Engineer's and the Contractor's responsibility to check the depth of cover and the
clearance.
8. All Existing and Proposed Manholes shall be located outside of the top bank of all
existing or proposed ditches and shall be at such an elevation as not to allow
rainwater entry during periods of normal rainfall. Manholes with a difference in
elevation of two feet or greater shall be a Drop Manhole unless approved by LRW.
Manhole Steps are not allowed in Little Rock Wastewater Standard
Specifications For Sewer Construction In The City of Little Rock.
9. All sewer mains shall be constructed within easements meeting Utility
Specifications or in a public right of way. Minimum width of proposed easement
shall be ten (10') feet (or the depth of cover whichever is greater) and shall be equal
distance either side of the sewer main as constructed.
10. No sewer main may be constructed under or within ten feet of any existing
detention basin or any detention basin being constructed for this project.
11. All buildings must be capable of being served by gravity sewer service. If minimum
floor elevations are required, it is the responsibility of the Developer to notify the
builder or Owner to assure gravity service is maintained. Individual pump stations
will not be accepted without LRW approval. This includes basement floor elevations.
12. Applicant agrees to obtain all necessary permits and approvals from all other
governing agencies including any applicable Improvement District prior to the start
of construction. APPLICANT SHOULD MAKE AN INDEPENDENT
DETERMINATION OF the existence, status or amount of any fees which may be due
third parties, such as Improvement Districts, which may be owed to the third party
in addition to those fees due to Little Rock Wastewater for sewer lines and or sewer
facilities installation proposed by applicant. The Little Rock Wastewater and Little
Rock Sanitary Sewer Committee have no such information of amounts due third
parties, if any, and assume no responsibility for furnishing such information to
Applicant and expressly disclaim any such duty or liability of any nature whatsoever
arising out of Applicant's failure to make that determination.

1. Applicant agrees to pay the following charges prior to start of construction of
the project:

2. This Project Will Not be eligible for reimbursement.
3. This letter shall not serve as an approval of any plat.
Approval of this project is conditional on the items mentioned above. It shall be the
Engineer's responsibility to notify the Applicant (Owner) and the Contractor of all the
items mentioned above. Failure to notify the Applicant of any of the items mentioned
above does not relieve the Applicant from constructing the project according to Little
Rock Wastewater Specifications and the terms of this approval letter.
