All land platted and any interest therein shall be held, owned and conveyed subject to and in conformity with the following covenants which, subject to being amended or cancelled as hereinafter provided, shall be and remain in full force and effect until January 1, 2029, to wit: 1. LAND USE AND BUILDING TYPE. The lands herein platted shall be held, owned and used only as an office building site, and no structures shall be erected, altered, placed or permitted to remain on any of the building plats together with such incidental and related structures. No residential activities of any kind shall be permitted to be conducted upon any of the building plots shown on the Plat. 2. PROPERTY LINES AND BOUNDARIES. Iron pins will be set on all lot corners and points of curve. In the event of minor discrepancies between the dimensions or distances as shown on the Plat and the actual dimensions or distances as disclosed by the established pins, the pins as set shall control. 3. ARCHITECTURAL CONTROL. No building shall be erected, placed or altered on any of the building plots until the building plans, specifications, exterior color scheme and plot plan showing the location of such buildings and improvements to adjoining streets and finished ground elevations have been approved in writing by the Grantor; provided, however, that in the event Grantor fails to approve or disapprove any such plans, specification, color schemes and plot plan within 30 days after such have been submitted for approval, this covenant shall be deemed to have been met by the owner submitting such plan for approval. 4. BUILDING LOCATION. No building or portion thereof shall be located on any building site outside of the building setback lines shown on the recorded Plat. The eastern most building line may not be modified or otherwise adjusted without the written approval of the Little Rock School District so long as the District is the owner of the adjacent property to the eastern property The document prepared by: 2 of 4 H. The violation or attempted violation of this provisions or any other provision, herein, may be prevented by injunction without bond and further is subject to any other remedies available at law or in equity. 5. EASEMENTS & UTILITIES. Easements for the installation, maintenance, operation and replacement of utility service and for drainage have been hereinabove reserved, said easements being expressly designated on the recorded Plat. No improvements shall be grown, built or maintained within the area of any utility easement. In the event any plant, structure, fence, pavement or similar improvement shall be maintained within the area of an easement, no utility will be liable for the destruction of the same in the installation, maintenance, repair or replacement of any utility service located within the area of such easement. 6. NUSANCES & TEMPORARY STRUCTRUES. No noxious or offensive activity shall be carried on upon any lot, nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood. No trailer, tent, commercial vehicle be temporarily or permanently stored nor shall any structure be used for human habitation. 7. SEVERABILITY. If any provision in this bill of assurance is for any reason unenforceable, the unenforceability will not affect any other provision and this agreement will be construed as if the unenforceable provision had never been a part of the agreement. 8. ALTERATION OR MODIFICATION. Except as provided in paragraph 4, all covenants, provisions and restrictions herein set forth may be amended, modified, extended, changed or cancelled, in whole or in part, only be a written instrument executed and recorded by the owners of not less than 51 % in number of the lots in this subdivision. Each of the covenants, provisions and restrictions contained herein shall remain in full force and effect for a period of 25 years from the date hereof, and shall be automatically renewed for successive periods of 10 years each unless cancelled, modified or amended as hereinbefore set forth. Nothing in this Bill of Assurance, expressed or implied, is intended or may be construed to confer on any person or entity, other than the parties and their respective heirs, successors, and assigns, any right, remedy, or claim by reason of ownership of property within the addition.
