BILL OF ASSURANCE
Lots 1R, 2R, 110R
Carriage Creek Subdision
KNOW ALL MEN BY THESE PRESENTS
THAT WHEREAS, Julia Wepfer is the Owner of the following de-
scribed property:
Lots 1, 2, and 110, Carriage Creek Subdivision, Little
Rock, Arkansas
NOW, THEREFORE, WITNESS:
That I, Julia Wepfer, hereinafter called Grantor, have
caused said property to be surveyed by Robert C. Lowe, Jr. & As-
sociates, Registered Professional Land Surveyor, and a plat
thereof made, bearing the title Lots 1R, 2R, 110R, Carriage
Creek Subdivision, being a replat of Lots 1, 2, and 110, Car-
riage Creek Subdivision, Little Rock, Arkansas, recorded as Plat
D-28. The said plat bears the seal and signature of said Sur-
veyor and the signatures of the Grantors. The said plat bears a
certificate of approval of the Little Rock Planning Commission
and is filed for record in the records of the Circuit Clerk and
Ex-Officio Recorder of Pulaski County, Arkansas, as Plat
Therefore, the Grantors do hereby make this Bill of Assurance.
The Grantors do hereby certify that they have replatted the
above -described property in accordance with the above -described
plat. The lands embraced in said plat shall be forever known as
designated on said plat and every deed of conveyance for said
property shall use these designations.
The Grantors further certify that the easements and
rights -of -way indicated on this plat have not been changed and
shall remain as indicated on the plat of Carriage Creek Subdivi-
sion recorded as Plat D-28 in the records of the Circuit Clerk
and ex-Officio Recorder of Pulaski County, Arkansas.
Finally, the Grantors certify that all provisions of the
Bill of Assurance for Carriage Creek Subdivision, recorded as
Document #89-69757 in the records of the Circuit Clerk and
ex-Officio Recorder of Pulaski County, Arkansas, shall apply to
and remain in full force and effect for Lots 1R, 2R, and 110R of
Carraige Creek Subdivision as replatted herein, except as here-
inafter amended.
Paragraphs Four, Nine, and Twenty shall be amended as follows:
4. Creation of Obliaation for Assessments. By acceptance
of a deed or other conveyance of property covered by this
Bill of Assurance each Owner, except the Owner of Lots 1R,
and 2 R. Carriage Creek Subdivision, , shall be deemed to
covenant and agree to pay any assessments, charges, and/or
special assessments which may hereinafter be levied by the
Pleasant Heights, Carriage Creek, Belle Point Property
Owners Association, for the purpose of promoting the recre-
ation, health, safety and welfare of the Owners, in par-
ticular for the Acquisition, servicing, improvement and
maintenance of Common Properties and facilities which may
hereafter be dedicated for use of Allotters,
9. Frontacte of Residence on Streets. Any residence
erected on Any lot in this addition shall front, or in
the case of Lots 110R and Lot 2 R, shall present a good
frontage on the streets designated in the plat. Nothing
contained herein shall require that a residence constructed
on these lots be built exactly and only facing the frontage
on the cul-de-sac.
20. Fences. No fences, enclosure of part of any building of
any type or nature whatsoever shall ever be constructed ,
erected, placed or maintained closer to the front lot line
than the building setback line applicable and in effect as
to each lot; provided, however, that chain link or similar
fences are in all events strictly prohibited and shall not
be used under any circumstances except with regard to Lot 2R

where field fence and wooden past may be used; provided fur-
ther that it is not the intentions of this paragraph to
exclude the use of evergreens or other shrubbery to land-
scape the front yards....

A new Paragraph shall be added as follows:
29. Lots 1R, 2R and 11OR shall be permitted to be kept
in their natural wooded state. Owner shall be under no
obligation to mow, clear, or improve property in any manner.
