ORDINANCE NO. 3 22,019 (AUGUST 3, 2021), TO DECLARE IT IMPRACTICAL AND 4 UNFEASIBLE TO BID; TO AUTHORIZE THE CITY MANAGER TO 5 AMEND THE AGREEMENT WITH THE CENTRAL ARKANSAS 6 LIBRARY SYSTEM, FOR AN AMOUNT NOT TO EXCEED ONE 7 HUNDRED THOUSAND DOLLARS ($100,000.00), TO PROVIDE 8 PROGRAMMING COORDINATION, MEETINGS AND APPLICATIONS 9 FOR THE BE MIGHTY SUMMER MEALS PROGRAM; TO DECLARE 10 AND EMERGENCY;AND FOR OTHER PURPOSES. 11 12 WHEREAS,in 2019,the Be Mighty Program,to reduce hunger in the Little Rock community,and to 13 expand participation in such a program,was funded by the National League of Cities and carried out by the 14 Central Arkansas Library System("CALS");and, 15 WHEREAS, it was determined to continue this program in 2020 with funds provided by the City of 16 Little Rock,Arkansas,and again to use CALS for the programming,coordination,meeting and application 17 for such programs;and, 18 WHEREAS,the data that CALS has gathered, the efforts it has taken and intend to take to extend 19 the participation in this program and the steps it is already prepared to take to extend this program 20 further so that more locations and more people will participate in the program; and, 21 WHEREAS,the loss of data compilation options in addition to the experience(s) that CALS has 22 gathered makes it impractical and unfeasible to subject this program to a competitive selection process; 23 and, 24 WHEREAS,the program has continued to be successful and beneficial through the first contract 25 extension in 2022; 26 WHEREAS,a Twenty-Five Thousand Dollar($25,000.00) funding increase for the second contract 27 extension in 2023 was approved for a total 2023 program benefit of One Hundred Thousand Dollars 28 ($100,000.00); 29 WHEREAS,a Twenty-Five Thousand Dollar($25,000.00) funding increase for the second contract 30 extension in 2023 was approved for a total 2023 program benefit of One Hundred Thousand Dollars 31 ($100,000.00); 32 and [Page 1 of 2] 1 WHEREAS, the Commission on Children, Youth and Families has endorsed the continuation of 2 funding for the contract year 2024-25 for a total 2024-2025 program benefit of One Hundred Thousand 3 Dollars($100,000.00). 4 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE 5 CITY OF LITTLE ROCK, ARKANSAS: 6 Section 1.The Board of Directors declares that it is impractical and unfeasible to submit the provision 7 of a citywide meal program to a competitive bid process, and,therefore,waives competitive bidding. 8 Section 2.The City Manager is authorized to enter into an agreement with Central Arkansas Library 9 System from July 1, 2024 through July 30, 2025 in an amount not to exceed One Hundred Thousand 10 Dollars ($100,000.00)to provide coordination of programming, meetings, and the Application of a 11 Summer Meals Program. 12 Section 3. Funds for this agreement are available in Account No. 108159. Activity Codes to be 13 assigned and funding after completion of contract process. 14 Section 4. Absent a change in circumstances, law, or legislation, which would make it practical and 15 feasible to submit this agreement to a competitive selection process,the City Manager has the authority 16 to grant the third contract extension for 2025, at the increased amount as provided in this ordinance. 17 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 18 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 19 adjudication shall not affect the remaining portions of this resolution,which shall remain in full force and 20 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 21 resolution. 22 Section 6.Repealer.
