Dear Richard:
We respectfully request that we be placed on the agenda for the full
Planning Commission meeting scheduled for April 19, 1988.
We wish to make this formal request at the subdivision subcommittee
Thursday April 7, 1988.
The reason for our request is that we were denied access by the staff
April 5, 1988 and wish to request a variance of the distance and location
requirements of the ordinance.
We respectfully request your help with this matter because we would have
a six week delay.

Master Street Plan Requirements
Dear Mr. Bailey:
Engineering Division
This letter is in regard to our discussion during the first week of
March concerning your request for access onto Bowman Road from the
adjoining property at Markham Park Drive. At that time, Don McChesney,
City Engineer and I had some concerns concerning the access with the
geometrics of Bowman Road. Also at that time you requested an additional
curb cut for the lot facing Bowman Road. We discussed at our meeting
that the Master Street Plan allows for only one curb cut every 300 feet
on a designated arterial road.
I have been searching the files to find any documents that allow for the
access point onto Bowman Road which provides access to the interior lot
for the major shopping center or store area. I have been unable to find
any written documentation that allows this access point. Therefore, due
to the geometrics of Bowman Road as well as the Planning Commission and
Board of Directors policy for Master Street Plan issues, only one curb
cut will be allowed onto Bowman Road from the piece of property discussed
earlier. In particular, the access point to the shopping area internal
to the development is not allowed at this time.
As we discussed, it appears that a right turn in and right turn out lane
would be appropiate since the existing Bowman Road does not allow for a
left turn lane in this area. Please discuss this with the City Engineer
or the Planning Commission to determine the status. With regard to the
lot facing Bowman if the access road is allowed into the interior parcel,
access from your property should tie into the access road and not onto
Bowman Road.

RE: Proposed site plan and building elevations to be
constructed on Lot 10, Markham Commercial Subdivision
Dear Danny:
I am in receipt of your letter of April 20 and 26, 1988. As
you know your project on Tract "A" and Lot 11 was approved by
the.Planning Commission on April 19, 1988, contingent on my
agreement to take access off your entrance to Tract "A" in lieu
of access off Bowman Road.
It is unacceptable to me to have our primary entrance off your
entrance to Tract "A". It does not work well because of grades
and easy egress and ingress.
The seller of my lot had obtained permission from the city to
have a curb cut on Bowman Road and Markham Park Drive, and I
need both for my intended use. This was the reason I bought a
corner lot and paid $10/s.f.
In my meeting with Don Bailey I told him if he would give me the
topo on Tract "A" and Lot 11, I would have Joe White make a site
plan that would work for you, the city and me. It appears you
are trying to change your subdivision without going through the
process. Access to Tract "A" was never intended through Lot 11.
As you know, architectural control must meet the rules of reason-
ableness, and I can assure you my building will be more attractive
and better landscaped than the existing construction, and that I
will have no more curb cuts than the other corner lots in this
subdivision.
Danny, I would be willing to explore the possibility of connecting
our parking lots if mutually beneficial and physically possible.

Bailey/Mitchell Properties is the owner of -,he above mentioned property.
As I am sure that you have probably noticed, we have constructed a smill
brick neighborhood shopping center on the property.
A shirt laundry and cosy cleaners has leased space in the south end of the
building for use as a pick up station. To provide cover frcmmm the elements
for their customers,they have constructed an attractive gray canvas awning
over the area used in. dropping off laundry. (See enclosed site plan.)
According to the CitNy's office of Ccmprehensive Planning, we are required
to ��_nd our "P1apneit Commercial Development" on the property to allaw
this canopy. At the time the canopy was installed, ,vre were not aware of
this.
this letter shall serve as your notice that we are requesting approval of
this canopy at the Planning Conmission meeting on May 31, 1988. This public
hearing will be held in the Board of Directors Chambers on the second floor
of City Hall at 1:00 p.m.
