3 • AN ORDINANCE TO APPROVE A PLANNED ZONING DEVELOPMENT
4 AND TO ESTABLISH A REVISED PLANNED COMMERCIAL
5 DEVELOPMENT TITLED CANTRELL WEST RETAIL CENTER—PCD,
6 LOCATED AT 15122 CANTRELL ROAD (Z-5817-N), LITTLE ROCK,
7 ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY
8 OF LITTLE ROCK,ARKANSAS; AND FOR OTHER PURPOSES.

10 BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
11 ARKANSAS.
12 Section 1. That the zoning classification of the following described property be changed from R-2,
13 Single-Family District and PDO,Planned District-Office,to PCD Planned Commercial Development:
14 Z-5817-N: Described as all of Lots 1 and 2 Magnolia Terrace Addition to the City of
15 Little Rock,filed for record Book H,Page 797,Records of Pulaski County,Arkansas;
16 Lands lying in the Fractional Northwest Quarter of the Fractional Northwest
17 Quarter of Section 19,Township 2 North,Range 13 West,City of Little Rock,Pulaski
18 County,Arkansas more particularly as follows:
19 Beginning at the Northwest Corner of the said Lot 1 Magnolia Terrace
20 Addition South 01 degrees 04 minutes 14 seconds East 215.11 feet to a point on the
21 North Right-of-Way of Arkansas Highway 10 (Cantrell Road); thence along said
22 North Right-of-Way North 75 degrees 17 minutes 14 seconds West 43.28 feet to.a
23 point on the East Line of Rummel Road; thence leaving said North Right-of-Way
24 along said East Right-of-Way North 15 degrees 07 minutes 42 seconds West 88.12
25 feet; thence North 64 degrees 10 minutes 10 seconds West 128.45 feet; thence North
26 13 degrees 13 minutes 58 seconds West 75.40 feet to a point on the North Line of the
27 said Fractional Northwest Quarter of the Fractional Northwest Quarter; thence
28 leaving said East Right-of-Way Line along said North Line South 86 degrees 56
29 minutes 34 seconds East 193.99 feet to the point of beginning; All containing 3.089
30 acres more or less.
31 Section 2. That the preliminary site development plan/plat be approved as presented to the Little Rock
32 Planning Commission. •

1 Section 3. That the change in zoning classification contemplated for Cantrell West Retail Center PCD,
2 located at 15122 Cantrell Road(Z-5817-N), is conditioned upon obtaining final plan approval within the
3 time specified by Chapter 36,Article VII, Section 36-454(e)of the Code of Ordinances.
4 Section 4. Conditions requested by the owner to reduce the risk of negative impact on the health,
5 safety,and welfare of the surrounding neighborhoods are:
6 a. The application of record must be consistent with the application recommended for approval
7 by the Planning Commission on July 11,2024,except for the following additions and updates
8 listed in points c-g below;
9 b. The updates to the application of record, consistent with points c-g, have been submitted to
10 Planning Staff and on the record before the Board of Directors Meeting on August 20,2024;
11 c. Language shall be added to application Z-5 817 N stating that if there is ever a driveway or any
12 form of access point that touches Rummel Road, it will be for emergency access only,
13 permanently gated with a Knox Box, and have appropriate screening; this requirement is
14 consistent with the conditions provided to the Developer in 2022;
15 d. Consistent with Ordinance No. 21,513 passed on December 5,2017
16 i. All businesses in this center will be lights out by 10:00 p.m.;
17 ii. There will be no deliveries,trash pick-up,or construction before 7:00 a.m.on Monday-
18 Friday,and no delivery,trash pick-up,or construction on weekends or holidays;
19 iii. Provided, a donut shop/bakery which may open at 5:00 a.m., no business shall open
20 before 12:00 noon on Sundays; and
21 iv. Provided further, an urgent care clinic may stay open until 11:00 p.m.
22 e. If there are two driveways touching Cantrell Road (Arkansas Highway 10), the eastern
23 driveway should be entrance only,and the western driveway should be exit only;
24 f. Sketch 3 of the application shall be updated to reflect the site plan provided by the applicant's
25 attorney to Mr.Grey Williams on August 8,2024(see Exhibit 1);and
26 g. The application must be updated to reflect the following usage parameters and only permitted
27 uses listed below. These parameters are consistent with the conditions provided to the
28 Developer in 2022. Uses with an asterisk(*)and in italics have been added or updated at the
29 request of the Developer based on a meeting that occurred on August 13, 2024. Letters are
30 consistent with Little Rock City Code.
31 i. No businesses that sell alcoholic beverages, except in the freestanding restaurant
32 location;and

1 ii. No businesses that sell tobacco related products, "vapes" related products, or other
2 products that require the purchaser to be 18 years old or older,or 21 years old or older,

30 Section 6. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock,
31 Arkansas, and the Designated District Map be, and is hereby amended, to the extent and in the respects
32 necessary to affect and designate the change provided for in Section 1 hereof.

1 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
2 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
3 adjudication shall not affect the remaining portions of the ordinance,which shall remain in full force and
4 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
5 ordinance.
6 Section 8. Repealer. All laws,ordinances,resolutions,or parts of the same that are inconsistent with
7 the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
