RE: Legal Opinion Regarding Napa Valley Apartments Density Question
Dear Mr. Magruder:
On September 29, 1983, the Subdivision Committee reviewed a request by
The Group, Inc. and Edward G. Smith & Associates for site plan review
of a 240 unit apartment complex on 13.71 acres, which will be located
at the northeast corner of Napa Valley and Mara Lynn Roads. The
proposal includes the realignment of Napa Valley Road in accordance
with the City's Master Street Plan and the City's design standards for
radial curves, correcting what is currently known as "dead -mans" curve.
Napa Valley will cross the property in such a way that a small, un-
buildable portion will be left on the southern end.
The applicant is requesting that he be allowed to use that portion of
the site to be dedicated as public right-of-way and the unbuildable
tract in the calculation of density for the entire project. He feels
that his position is supported by the Ordinance's definition of gross
acreage, which is defined as "the total acreage of the proposed de-
velopment including areas designated for internal streets and other
public facilities."
Since we were unwilling to support the use of land within the public
right-of-way in this manner, the Subdivision Committee directed the
staff to seek legal guidance. Therefore, we are requesting that you
submit a formal legal interpretation of the definition as it applies
to the described situation before the October llth Public Hearing.
We have no objection to use of the unbuildable tract for density
calculation.
