Engineering Considerations Request that street improvements on Sam Peck be extended through the water easement during this project or on a future adjacent project. D. Analysis Staff has no problems with the proposed layout. The major issue here relates to the sewer density restriction in this area. Since a precedent has been set by denial of density transfers for the Pleasant Valley Condominiums to the east, this application cannot be allowed to violate the density restriction under any circumstances. E. Staff Recommendation Approval, subject to comments made. December 13, 1983 SUBDIVISIONS Item No. 13 - Continued SUBDIVISION COMMITTEE REVIEW: There was considerable discussion relative to the density question. The applicant contended that the restrictions on this area should not apply to this property, since it was rezoned in June 1980, which was prior to adoption of restrictive resolution on May 5, 1981. A letter from Wastewater Utilities stating the present capacity to serve this tract was presented. The Committee passed this to the Commission, subject to a legal opinion by the City Attorney which would give some evidence of whether or not the situation is comparable to other proposals in the area which have been restricted. PLANNING COMMISSION ACTION: The applicant was present. No one objected. Due to Wastewater's approval of the project and the prior rezoning status of the property, staff modified its position to that of approval. A motion was made and passed to approve the item, subject to Engineering considerations. The vote: 8 ayes, 0 noes, 2 absent and 1 abstention (Commissioner Summerlin abstained).
