Abandonment for Zion Street
LOCATION: located on the Northeast Corner of West 38th and Zion Streets
Planning Staff Comments:
1. Provide notification of abutting property owners of the site, complete with the
certified abstract list, notice form with affidavit executed and proof of mailing. The
notice must be mailed no later than December 3, 2008. The Office of Planning and
Development must receive the proof of notice no later than December 12, 2008.
2. Locate the existing sewer main located within Zion Street and provide a side yard
setback outside the easement.
3. Provide a front building line of 25-feet along West 38th Street.
4. Provide authorization from the property owner located to the west concerning the
abandonment of Zion Street.
Variance[Waivers: None requested.
Public Works Conditions:
1. West 38th Street is classified on the Master Street Plan as a residential street. A
dedication of right-of-way 25 feet from centerline will be required. Provide a survey
showing the existing centerline of West 38th Street.
2. With site development, provide the design of street conforming to the Master Street
Plan. Construct one-half street improvements to West 38th Street including 5-foot
sidewalk with the planned development. The new back of curb should be located 13
feet from centerline and the back of the sidewalk should be located at the property
line.
3. No public drainage infrastructure is located in the Zion Street right-of-way.
4. Repair or replace any curb and gutter or sidewalk that is damaged in the public right-
of-way prior to occupancy.
5. Plans of all work in right-of-way shall be submitted for approval prior to start of work.
Obtain barricade permit prior to doing any work in the right-of-way from Traffic
Engineering at (501) 379-1805 (Travis Herbner).
Utilities and Fire Department/County Planning:
Wastewater: Existing sewer main located in Zion Street and in Lot 10. Easement
must be provided before replat and Little Rock Wastewater Utility can approve
abandonment. Contact Little Rock Wastewater Utility for additional information.
Entergy: No comment received.

Center -Point Energy: No comment received.
AT & T: No comment received_
Central Arkansas Water: No objection. Central Arkansas Water does have an 8-inch
water main in Zion Street, but it is near the west right-of-way and should not be a
problem if just the east half of the right-of-way is abandoned.
Fire Department: Approved as submitted.
County Planning: No comment.
CATA: The site is not located on a dedicated CATA Bus Route.
Planning Division: No comment.
Landscape: No comment.
Revised plat/plan: Submit four (4) copies of a revised preliminary plat/plan (to include
the additional information as noted above) to staff on Monday, December 1, 2008.

The applicant was not present. Staff presented the item stating the applicant had
contacted them on December 2, 2008, requesting a deferral of the item to the
February 5, 2009, public hearing. Staff stated they were supportive of the deferral
request.

The applicant has not contacted staff concerning this request since the previous public
hearing. Staff recommends this item be deferred to the March 19, 2009, public hearing.
PLANNING COMMISSION ACTION: (FEBRUARY 5, 2009)
The applicant was not present. There were no registered objectors present. Staff
presented the item stating the applicant had not contacted them concerning the request
since the previous public hearing. Staff presented a recommendation the item be
deferred to the March 19, 2009, public hearing.
There was no further discussion of the item. The Chair entertained a motion for
approval of the Consent Agenda as presented by staff. The motion carried by a vote of
10 ayes, 0 noes and 1 absent.

There has been no contact with the applicant since the previous public hearing. Since
the item has been deferred previously two times staff recommends the item be
withdrawn, without prejudice, and re -filed once the applicant has all the issues resolved
related to the plat.
