7. The staff does not offer opposition to the use intended
nor do we feel compelled to recommend a commercial
zone. We do feel that the owner of this site and the
corner lot can reach a better design approach on the
lots through a site planning effort utilizing the PUD
short form. That approach would allow flexibility in
location of parking, control of access and
establishment of a projected tenant use list. This
list ❑f uses would permit future leases or rental
efforts without further public review. The staff feels
that a sensitive location such as this corner with
considerable investment being placed on adjacent
properties requires more than simple rezoning and
leaving development to chance.
STAFF RECOMMENDATION:
Denial of the "C-1" zoning requested and recommend that the
applicant refile a short form Planned Unit Development
encompassing both this lot and the corner billboard site.
PLANNING COMMISSION ACTION:
The applicant and owner were present. Both made comments in
support of the "C-l" request and offered a position on the
PUD approach recommended by staff. They expressed the
thought that Planned Unit Development was not needed in this
instance due to the location and the scale of the project.
Further, they stated that they had not received such
direction from the staff prior to their filing. A lengthy
discussion followed. A motion was made to accept a
withdrawal of the application without prejudice in order to
permit a refiling as a short form PUD. The motion included
no filing fee additional required and the application for
PUD is to be developed through meetings with the staff and
working out the details before the next docket closing date.
The motion passed by a vote of 11 ayes, 0 noes and 0 absent.

A. SITE HISTORY
This item was reviewed by the Commission on
September 27 as a request for rezoning from "0-3"
General Office to 11C-1" Neighborhood Commercial. Staff
felt that a PUD would be better, since it would allow
flexibility in the location of parking, control of
access and establishment of a projected tenant .list and
not a precedent for the commercial strip. This list
would permit future leases of rental efforts without
further public review. The Commission agreed.

D. ENGINEERING CONSIDERATIONS
None.
E. ANALYSIS
The plan as submitted does not indicate a parking
layout. The applicant is asked to show this
information and pave the parking lot.
F. STAFF RECOMMENDATION
Approval, subject to comments made.
G. SUBDIVISION COMMITTEE REVIEW:
Staff reported that the PUD process is recommended for
this item so as not to set a precedent for commercial
rezoning in this area, to fix structural uses on the
property and to use for groupings on the two lots
("C-l" on Lot 5, "C-3" on Lot 6). The applicant agreed
with the staff recommendation to pave the parking
area.
PLANNING COMMISSION ACTION:
The applicant was present. There were no objectors. An
acceptable plan for parking was submitted and a commitment
to pave the parking lot was made. A motion for approval was
passed by a vote of 10 ayes, 0 noes and 1 absent.

PLANNING CONSIDERATIONS:
1. The site involved is a single 50-foot lot with little
or no access to the rear for access to parking. The
present off-street parking is on the billboard site to
the west and the applicant states that will continue to
be the case.
2e The area is one of rough lots with sharp grade changes,
high foundations and poor access.
3. There are no Master Street Plan right-of-way
requirements or Master Plan issues attendant to this
request.
4. There are no reported adverse effects on public
services or utilities.
5. There are no apparent legal issues attendant to this
request.
6. There are no recorded neighborhood comments on further
commercialization of Cantrell Road.
