CANDLEWOOD # III SUBDIVISION
KNOW ALL MEN BY THESE PRESENTS:
THAT CHAR -BECK TRUST, JOHNNY B. MITCHUM, TRUSTEE, is the sole
owner of Lots 1 through 5, CANDLEWOOD # III SUBDIVISION to the City
of Little Rock, Pulaski County, Arkansas; and
The Bill of Assurance to CANDLEWOOD # III SUBDIVISION is
recorded as Instrument No. 89 67985 in the records of the Circuit
Clerk and Ex-officio Recorder of Pulaski County, Arkansas, and the
Plat is of record in Plat Book C at page 901; and
The owner wishes to amend the Plat and Bill of Assurance as
follows:
1. Paragraph 1 of the Bill of Assurance is amended by adding
at the end thereof the following sentence:
All buildings shall be set back at least
fifteen (15) feet from the edge of the street
right-of-way.
2. Paragraph 5 of the Bill of Assurance is amended by
deleting the existing paragraph 5(a) and substituting the
following:
5. (a) DEDICATION. The fifty -foot
(501) private drive shown on the Plat is
dedicated to the public for use as a street
with any portion of the right-of-way available
for use of utilities serving the property.
The drainage easements and utility easements
shown on the Plat are for the benefit of the
owners of the lots and utilities serving the
lots.

and on behalf of said Trust; and further stated that he had so
signed, executed and delivered said instrument for the
consideration, uses and purposes therein mentioned and set forth.

with any portion of the right-of-way available
for use of utilities serving the property.
There shall be no vehicular access to this
street from property fronting it to the south.
The drainage easements and utility easements
shown on the Plat are for the benefit of the
owners of the lots and utilities serving the
lots.
Also joining in the foregoing dedication are the undersigned,
Ossama Almefty and Janice Almefty, his wife, who have made an offer
to purchase Lot 2, CANDLEWOOD # III SUBDIVISION, pending approval
of the amended Plat and this Amendment to Bill of Assurance.
