Re:- Waffle House Location at the Northeast Corner of
West Markham Street and Shackleford Road
Dear Mr. Kapp:
In response to your inquiry, the following information and
site history are offered.
The three,access points provided the Waffle House at the
referenced location are fixed by action of the Little Rock
Planning Commission. -These points are:
1. A common access with the Gulf Station onto Shackleford
Road, Seethe attached plat.
2. An`ace" s easement parallel to Shackleford Road 70 feet
.in width to be allowed one additional point of access
to Shackleford at the northernmost point. See attached
plat.
3. An access drive off West Markham Street on the west
side of and adjacent to the liquor store. This
easement extends from West Markham Street to a point
adjacent to the northeast corner of the restaurant
site. See the attached plat.
These access points are permanently fixed except for the
ooint on West Markham Street. The Planninq Commission
permitted this access tie to the Waffle House for
circulation until such time as a suitable internal
circulation plan could be devised. That plan has been
approved by the Planning Commission involving all of the
properties lying east and north of ter. Mays' property. This
plan provides for a properly designed intersection at West
Markham Street on the east side of the liquor store. the
primary access drive provided by this plan provides for two
access points to the plat on the west occupied by the Waffle
House. Mr. Mueller and Mr. May, the present owners, have
agreed to these points of access. They have also agreed to
design further building construction sites and parking so as
to provide your site and the new building with a proper
traffic flow.
Once these access points are provided, these owners will
provide a replat of their Lot 2, Phase 2, which will
eliminate the present West Markham Street access point
thereby shifting your circulation pattern approximately one
lot width to the east. (See the note on the attached plat.)
This office has discussed with Mr. May a general layout for
several new buildings which will require a Planning
Commission review. It would be in your interest to observe
these proceedings and perhaps become involved to assure
proper attention to your concerns. If you have questions
which this letter and the attachments fail to deal with,

B. Proposal
(1) The construction of a shopping center on 6.8
acres.
(2) Construction of approximately 72,500 gross square
feet of retail shops. The typical of most will be
2500 square feet.
(3) Parking will consist of 237 parking spaces.
C. "C-3" Requirements
(1) Minimum lot area 14,000 square feet and lot width
not less than 100 feet. The plan complies.
(2) Minimum front yard of 25 feet. The plan complies.
(3) Minimum rear yard of 25 feet. The plan complies.
D. En ineerin Considerations
(1) Request roadway between this development and the
Kroger Store be modified to preclude a direct
route from the Kroger site to West Markham Street.

(2) Recommend the north -south street section be offset
to the east as it approaches the main east -west
street of this development.
(3) Request that the engineer discuss this matter with
City Engineers.
E. Analysis
Staff's major concern with this project was the
assurance of adequate internal access design to
incorporate both this project, previous developments on
abutting properties, and a future parcel outside of
this ownership. This site represents the balance of
property at this northeast corner, and it is imperative
that a cohesive circulation system be developed.
Specifically, staff is concerned with traffic
generation on the north -south street to West Markham.
We would not like to see this site as a short means by
which motorists can get to Markham, nor as a speedway.
To alleviate such problems, we concur with the
modifications to the site plan as proposed by the City
Engineers.
F. Staff Recommendation
Approval, subject to comments made.
SUBDIVISION COMMITTEE REVIEW:
Mr. Joe White and Ron Tabor were present representing the
application. A lengthy discussion was held, the result
being that. Mr. Tabor and Mr. White will hold discussions
with the developer of the property to the north and other
involved parties with a view toward developing a north/south
street to accommodate the concerns of the traffic engineer.
Mr. Tabor also submitted a revised plan of this project
incorporating in the southernmost building in a drive-in
branch financial institution. It was noted that this does
not significantly impact the design of the plan.
PLANNING COMMISSION ACTION:
The applicant was present. There were no objectors. A
revised plan was submitted. Engineering reported that they
had met with the developers and most of their concerns had
been addressed. Their only comment was that enough stacking
space be left behind the bank building. After listening to
the developers' concerns, they had also decided to withdraw
their comment about offsettin4 the north/south street.

Mr. Ron Tabor, the applicant, reported that he had been
unsuccessful in gaining the adjacent owner's cooperation
regarding access. He requested that the Commission not
delay his proposal because of this. The Commission agreed
that it would be unfair to penalize this developer because
of this. Staff reported that the Fire Department had
requested all drives to be a minimum of 20 feet. )Two
motions were made and passed. Motion 1: Approval, as
revised or if arrangement can be worked out with adjacent
property owner prior to submission of_.fina�_p1at, limitation
of curb cuts be to two and street be moved 15 feet on to
adjoining property. The vote - 8 ayes, 0 noes, 3 absent.
Motion 2: That a letter be sent by staff to adjacent
property owners strongly urging him to cooperate in this
development and re-emphasizing the Commission's intent to
grant him only one more curb cut to Shackleford and no
access to Markham, except to the Waffle House. The vote was
8 ayes, 0 noes and 3 absent.

square footage will be approximately 75,000 gross square feet
situated on 6.8 + acres.
My client is anxious to have this site plan reviewed by you and other
members of the Planning Staff, along with the Subdivision Committee of
the Little Rock Planning Commission. Mr. Joe White will represent my
client in regard to the engineering requirements, and Mr. Rex Wilkins
will be the architect for the construction and all documentation
pertaining to this development.
Please notify me at your earliest convenience in regard to any addi-
tional information that you will require for a complete review. The
sellers of this site are currently providing us with additional engi-
neering information, since a significant amount of site work has been
accomplished within the last 30 to 45 days. As you know, this site
will represent the balance of the acreage to be developed at the
Northeast corner of this intersection, and it is important that the
previous developments that are contiguous (proposed) be analyzed by
staff in order to arrive at a cohesive development plan.
