3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK. ORDINANCE NO.
4 22,343 (DECEMBER 5, 2023), TO ADJUST THE FISCAL YEAR 2024
5 BUDGET ORDINANCE TO REFLECT EXPENDITURE ADJUSTMENTS
6 FOR THE GENERAL FUND AS IT PERTAINS TO THE AMERICAN
7 RESCUE PLAN ACT; TO DECLARE AN EMERGENCY; AND FOR
8 OTHER PURPOSES.

10 WHEREAS, the City of Little Rock, Arkansas (City) approved a Comprehensive Budget in Little
11 Rock,Ark.,Ordinance No.22,343 (December 5,2023);and,
12 WHEREAS,it is appropriate to adjust the ordinance to reflect operational changes in the General Fund,
13 and where necessary to authorize the increase or decrease in the Fiscal Year 2024 line items for these and
14 other matters; and,
15 WHEREAS, the City approved the allocation of the second tranche of American Rescue Plan Act
16 (ARPA)Funds and State and Local Fiscal Recovery(SLFR)Funds via Little Rock,Ark.,Resolution No.
17 15783 (September 6,2022)and Little Rock,Ark.,Resolution No. 15847(December 20,2022); and,
18 WHEREAS, SLFR Funds have a December 31, 2024, obligation date for the funds and it is not
19 expected that the funding obligation for the Senior Center Facility, Little Rock Fire Department Capital
20 needs,Little Rock Fire Station No.25 and the new West Little Rock Station,Drainage Projects as Targeted
21 Community Development and Infrastructure as Economic Development will occur by the date;and,
22 WHEREAS, the City has documented public sector revenue loss stemming from the COVID-19
23 Pandemic to allocate to the SLFR Funds for Governmental Services to allow for the reallocation of General
24 Fund expenditures of the Little Rock Fire Department to the grant project for expenditures already incurred,
25 and thus not reducing any funding for the department to Special Projects for the Senior Center Facility,
26 Drainage Projects as Targeted Community Development,Little Rock Fire Department Capital Needs,the
27 new West Little Rock Station and Infrastructure as Economic Development to ensure the projects are
28 completed as originally intended;and,
29 WHEREAS, the Mayor, City Manager, and the Chief Financial Officer, in compliance with City
30 Budget and Financial Reporting Policies, have reviewed these adjustments and recommend them to the
31 Board of Directors for approval.
32 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
33 OF LITTLE ROCK,ARKANSAS:

1 Section 1. General Fund Section 5 of Little Rock,Ark.,Ordinance No.22,343 (December 5,2023)
2 is hereby amended to reflect no change to the operating resources in the General Fund of Two Hundred
3 Fifty-Seven Million,Five Hundred Ten Thousand,Two Hundred Twenty-One Dollars($257,510,221.00),
4 and to reflect no net change in the operating budgets for the General Fund Departments of Two Hundred
5 Fifty-Seven Million,Five Hundred Ten Thousand,Two Hundred Twenty-One Dollars($257,510,221.00);
6 however, the Department budget of the Little Rock Fire Department will decrease by Six Million, Six
7 Hundred Thousand Dollars ($6,600,000.00) and the Executive Administration Department Budget will
8 increase by Six Million,Six Hundred Thousand Dollars($6,600,000.00)to transfer the funds to the General
9 Fund Special Projects Fund for the Senior Center Facility, Drainage Projects as Targeted Community
10 Development, Little Rock Fire Department Capital Needs, the new West Little Rock Station and
11 Infrastructure as Economic Development.
12 Section 5. Records. The Chief Financial Officer is directed to maintain appropriate records which
13 provide greater detail for the adjustments set forth in this ordinance and as reflected in the materials
14 provided to the Board of Directors on July 30,2024.
15 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
16 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
17 adjudication shall not affect the remaining portions of the ordinance,which shall remain in full force and
18 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
19 ordinance.
20 Section 7. Repealer. All laws, ordinances,resolutions, including but not limited to Little Rock, Ark.
21 Ordinance No. 22,343 (December 5, 2023), or parts of the same,that are inconsistent with the provisions
22 of this resolution,are hereby repealed to the extent of such inconsistency.
23 Section 9. Emergency Clause. The City's ability to properly maintain its budgets and to account for
24 its funds is essential to maintain the public health,safety, and welfare;an emergency is, therefore,declared
25 to exist and this ordinance shall be in full force and effect from and after the date of its passage.
