TUCKER COMPANY, INC., IN AN 5 AMOUNT NOT TO EXCEED SEVEN HUNDRED NINETEEN 6 THOUSAND, FOUR HUNDRED FIFTY-FIVE AND 20/100 DOLLARS 7 ($719,455.20), FOR THE WALKER STREET DRAINAGE 8 IMPROVEMENT PROJECT; AND FOR OTHER PURPOSES 9 10 WHEREAS,bids were solicited for the Walker Street Drainage Improvement Project,Bid No. 2571; 11 and, 12 WHEREAS,H.W. Tucker Company, Inc., submitted the lowest responsive, responsible bid meeting 13 specifications of the one(1)bid received for the project; and, 14 WHEREAS,the total cost of the project shall not exceed Seven Hundred Nineteen Thousand, Four 15 Hundred Fifty-Five and 20/100 Dollars($719,455.20),which includes a 20%contingency. 16 NOW,'THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 17 OF LITTLE ROCK,ARKANSAS: 18 Section 1. The Board of Directors authorizes the City Manager to execute an agreement with H.W. 19 Tucker Company, Inc., in an amount not to exceed Seven Hundred Nineteen Thousand, Four Hundred 20 Fifty-Five and 20/100 Dollars ($719,455.20), which includes a 20% contingency, for the Walker Street 21 Drainage Improvement Project. 22 Section 2. Funding for this project is allocated in the Limited Tax General Obligation Capital 23 Improvement Bonds as authorized by Little Rock, Ark., Resolution No. 15,9668(May 2, 2023), Account 24 No.B6D061D. 25 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 26 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 27 adjudication shall not affect the remaining portions of the resolution,which shall remain in full force and 28 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 29 resolution. 30 Section 4. Repealer.
