HomeMy WebLinkAboutS-0745-E Application-f AMENDMENT TO BILL OF ASSURANCE KNOW ALL MEN BY THESE PRESENTS: WHEREAS, on July 13, 1987, B. G. Coney and James Matthews, (Allotters), executed a certain Bill of Assurance which applies to Rainwood Cove, an addition to the City of Little Rock, Pulaski County, Arkansas and appears of record in the Office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas as Instrument No. 87-48000, recorded July 24, 1987, and; WERHEAS, on November 4, 1988, Premiere Homes, Inc. executed a certain Amendment to Bill of Assurance, which applies to Rainwood Cove, an addition to the City of Little Rock, Pulaski County, Arkansas, and appears of record in the Office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas as Instrument No. 88-60311, recorded November 10, 1988, and; WHEREAS, on April 6, 1992, A. S. Rosen and Associates, Inc., executed a certain amendment to Bill of Assurance, which applies to Rainwood Cove, an Addition to the City of Little Rock, Pulaski County, Arkansas, and appears of record in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas as instrument No. 92-21359, recorded April 7, 1992, and; WHEREAS, on July 21, 1992, A. S. Rosen and Associates, Inc., executed a certain amendment to Bill of -Assurance, which applies to Rainwood Cove, an addition to the City of Little Rock, Pulaski County, Arkansas and appears of record in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas as instrument No. 92-46266, recorded July 22, 1992. WHEREAS, all title and interest in 32 of the 50 lots in said property were conveyed to A. S. Rosen and Associates, Inc. by Warranty Deed recorded at the Office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas as Instrument No. 92-13183, recorded March 4, 1992, and 30 lots of the land described in the original Bill of Assurance remain in the name of A. S. Rosen and Associates, Inc., to wit: Lots 2,4,13,14,15,16,17,18,19,20,21,22,23,24,25,26,27,32,33,34,35, 37,38,40,41,42,43,45,49, and 50 all in Rainwood Cove, an Addition to the City of Little Rock, Pulaski County, Arkansas. WHEREAS, circumstances require an amendment to said Bill of Assurance that affects certain portions of the original Bill of Assurance, and; WHEREAS, A. S. Rosen and Associates, Inc. as successors and assigns from the original Allotters, hereby amend the Bill of Assurance and all prior Amendments to Bill of Assurance of Rainwood Cove, an Addition to the City of Little Rock, Pulaski County, Arkansas, as follows: s Amend Paragraph 4 of the original Bill of Assurance as follows: 4. Setback Requirements. No residence shall be located on the lot nearer to the front lot line, rear lot line, or nearer to the side street line than the minimum building setback lines shown on the recorded plat; However, except for corner lots, if no rear lot line setback is shown on the recorded plat, the rear lot line setback requirement shall be 20 feet. No building shall be located nearer to an interior lot side than a distance of 5 feet. Corner lots will be subject to the requirements of the City of Little Rock with regard to the distance from the rear lot line for a principal dwelling. For the purposes of this covenant, eaves, steps, open porches, fireplaces and bay windows shall not be considered as a part of the building. Said Bill of Assurance of Rainwood Cove Addition, an addition to the City of Little Rock, Arkansas, heretofore filed in the Office of the Circuit Clerk and Ex-Officio Recorder in fand for Pulaski County, Arkansas on July 24, 1987, as Instrument No. 87-48000; and said Amendment to Bill of Assurance of Rainwood Cove Addition, an addition to the City of Little Rock, Arkansas, heretofore filed in the Office of the Circuit Clerk and Ex-Officio Recorder in and for Pulaski County, Arkansas on November 10, 1988, as Instrument No. 88-60311, and said amendment to Bill of Assurance of Rainwood Cove Addition, an Addition to the City of Little Rock, Arkansas, heretofore filed in the Office of the Circuit Clerk and Ex-Offcio Recorder in and for Pulaski County, Arkansas on April 7, 1992, as Instrument No. 92-21359, and said amendment to Bill of Assurance of Rainwood Cove Addition, an Addition to the City of Little Rock, Arkansas, heretofore filed in the office of the Circuit Clerk and Ex-Officio recorded in and for Pulaski County, Arkansas on July 22, 1992, as instrument No. 9246266, shall in all other respects remain in full force and effect. Executed in Little Rock, Arkansas, on the *2 �14-- day of September, 1992, with said corporate grantor acting through its President and Secretary, respectively, and said officers being authorized to execute this instrument by appropriate resolution of the Board of Directors and Stockholders of said corporation.
