CODE § 4-71 4 (b) (1988) TO EXTEND THE HOURS OF ON-PREMISE SUNDAY SALES 5 OF ALCOHOLIC BEVERAGES FROM 10:00 AM TO 12:00 MIDNIGHT; 6 TO DECLARE AN EMERGENCY;AND,FOR OTHER PURPOSES. 7 8 WHEREAS,pursuant to Little Rock,Ark., Ordinance No. 15,527 (August 2, 1988), and Little Rock, 9 Ark., Ordinance No. 15,588 (November 15, 1988), an election was held which approved the on-premises 10 sale of alcoholic beverages within the City at hotels, motels and restaurants, and as a result Little Rock, 11 Ark.,Rev. Code §4-71(b)(1988)was codified; and, 12 WHEREAS, since this election thirty-six (36)years ago, the General Assembly has acted further on 13 the question of Sunday on-premises alcohol sales which would permit the City of Little Rock,Arkansas 14 ("the City"),by ordinance,to amend the hours to be from 10:00 AM to 12:00 midnight in such locations. 15 NOW,THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 16 OF LITTLE ROCK,ARKANSAS: 17 Section 1. Little Rock,Ark.,Rev.Code §4-71 (b)(1988)is hereby amended to read as follows: 18 (b) Provided; however, that hotels and restaurants that possess a permit for on-premises 19 consumption of alcoholic beverages,and that obtain a State License to do so,may sell 20 alcoholic beverages for on-premise consumption on Sundays between the hours of 21 10:00 AM and 12:00 midnight. The privilege of selling alcoholic beverages for on- 22 premises consumption on Sunday within the corporate limits of the City shall be 23 governed by rules and regulations set forth in relevant Arkansas State Statutes,as may 24 be amended,or as promulgated by the Arkansas Alcoholic Beverage Control Board,or 25 its successor. 26 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 27 word of this ordinance is declared or adjudged to be invalid or unconstitutional,such declaration or adjudi- 28 cation shall not affect the remaining portions of the ordinance,which shall remain in full force and effect 29 as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordi- 30 nance. 31 Section 3.Repealer. All ordinances,resolutions,bylaws,and other matters inconsistent with this ordi- 32 nance, including but not limited to Little Rock,Ark., Ordinance No. 15,527 (August 2, 1988) and Little 33 Rock, Ark., Ordinance No. 15,588 (November 15, 1988) are hereby repealed to the extent of such (Page 1 of 2] 1 inconsistency. 2 Section 4. Emergency.
