HomeMy WebLinkAboutS-0722-Q ApplicationREPLAT LOT 32, BLOCK 4, CHERRY CREEK, AN ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS, REPLATTED AS LOT 32R, BLOCK 4, CHERRY CREEK, AN ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS WINROCK DEVELOPMENT COMPANY TO THE PUBLIC WHEREAS, Winrock Development Company executed and filed an Amended and Corrected Plat and Bill of Assurance for Cherry Creek, such document being filed on January 4, 1996, in the office of the Circuit Clerk and Recorder of Pulaski County as Instrument No. 96-742 and covering a number of lots, including Lot 32, Block 4, Cherry Creek, an addition to the City of Little Rock; and WHEREAS, the survey plat prepared by White-Daters & Associates, Inc., registered land surveyors, covering such property was filed in the office of the Circuit Clerk and Recorder of Pulaski County, Arkansas, in Plat Book E-515; and THIS INSTRUMENT PREPARED BY: H. Baker Kurrus SHULTS, RAY & KURRUS 200 West Capitol, Suite 1600 Little Rock, Arkansas 72201-3637 WHEREAS, Winrock Development Company, as Grantor, wishes to replat Lot 32, Block 4, and to redesignate such property for all lawful purposes as Lot 32R, Block 4, Cherry Creek, an addition to the City of Little Rock, Now, Therefore, WITNESSETH: Grantor does hereby certify that it has caused said tract to be resurveyed by White- Daters & Associates, Inc. and a plat thereof made which is identified by the title Lot 32R, Block 4, Cherry Creek, an addition to the City of Little Rock, Arkansas (hereinafter referred to as "the Replat"), being a Replat of Lot 32, Block 4, such Replat bearing the date of or:I IS_ I�JS96 , and bearing a certificate of approval executed by the Little Rock Planning Commission. The Replat has been filed of record in the office of the Circuit Clerk and Recorder of Pulaski County, Arkansas, in Plat Book The building setback lines and other data shown on the Replat are hereby amended and substituted in respect of Lot 32R, Block 4, Cherry Creek. All remaining terms, conditions, covenants, restrictions, easements, and other declarations of the original Amended and Corrected Plat and Bill of Assurance are hereby incorporated by reference and are hereby made applicable to Lot 32R, Block 4, Cherry Creek, except as expressly amended by the Replat. Grantor represents and warrants that it is the owner of the specific lot in question and the owner of additional property covered by the original Amended and Corrected Plat and Bill of Assurance. Under the terms of the original Amended and Corrected Plat and Bill of Assurance, Grantor is duly authorized and empowered to make this amendment -2- upon the approval by or on behalf of the Little Rock Planning Commission. Tyne and Gary Catlett, to me well known, who stated and acknowledged that they were President and Secretary, respectively, of Winrock Development Company, a corporation organized under the laws of the State of Arkansas, and as such were duly authorized in their respective capacities to execute the foregoing document for and in the name and on behalf of said corporation, and further stated that they had so signed, executed, and delivered the instrument for the consideration, uses, and purposes therein mentioned and set forth.
