Dear Mr. Greeson:
I am writing this letter to officially request that you begin proce-
dures for revocation of the "Shell Blakely Short Form PCD" for the
property which I own at 2408 Cantrell Road. This PCD was approved by
the Little Rock Board of Directors on November 4, 1986 through the
adoption of Ordinance No. 15195. Nearly 14 months have passed since
that date and it is clear that the development of the PCD as approved
will be infeasible. In accordance with the Zoning Ordinance, Article
IX, Section 9-101(h)(1)a. "the Planning Commission may recommend to
the Board of Directors that any previous Planned Unit Development ap-
proval be revoked if the applicant has not submitted a final
development plan to the staff within one year of preliminary plan ap-
proval."
Section 9-101(h)(2) Procedures for Revocation specifies in sub-
section a. that "prior to recommendation of revocation, notice by
certified mail shall be sent to the land owner or his authorized agent
notifying him of his alleged default and setting a time at which he
shall appear before the Planning Commission to show cause why steps
should not be made to totally .. revoke his Planned Unit
Developrie;it. !' As the owner and applicant for the previously approved
PCD, I hereby waive further notification by certified mail of these
procedures and for the record concur in revoking the PCD to the previ-
ously established zoning for this property, that is I-2 Light
Industrial District.
It is my understanding that the legal description for this property
associated with Ordinance 15195 is contained in your Subdivision File
No. 715 as associated with PC Case Z-4743. Your initiation of this
revocation procedure at the earliest possible date will be appreci-
ated. Please do not hesitate to contact me should you need additional
information or require clarification. I would appreciate your advis-
ing me as to the date upon which revocation occurs and the property is
returned to the I-2 Light Industrial District zoning classification.

AN ORDINANCE REPEALING ORDINANCE
NO. 15,195 AND REVOKING A PCD DISTRICT
TITLED SHELL BLAKELY "SHORT -FORM" PCD
(Z-4743) IN THE CITY OF LITTLE ROCK.
WHEREAS, Ordinance No. 15,195 was passed on November 4,
1986; and
WHEREAS, the Ordinance changed the zone classification
from "I-2" Industrial to "PCD" Planned Commercial District
on the following described property:
Lot 3, Caldwell Addition and Lot 4, 5, 6R and 7,
Caldwell Replat of Lots 1 and 2, Caldwell Addition to
the City of Little Rock; Tracts 1 and 2, Razorback
Square Shopping Center. Addition to the City of Little
Rock; Tract "A" Replat Phase I, Riverfront Addition to
the City of Little Rock; Tract "B" Replat Phase I,
Riverfront Addition to the City of Little Rock; that
part of the SW 1/4, SW 1/4, Section 33, T-2-N, R-12-W,
in the City of Little Rock, Pulaski County, Arkansas,
described as follows:
Beginning at the NW corner of said SW 1/4, SW 1/4,
Section 33; thence S 970 feet, more or less, to a point
350 feet North of the SW corner of said Section 33;
thence E 50 feet; thence S 15 feet; thence E 550 feet;
thence S 335 feet to the South line of said Section 33;
thence East along said South line of Section 33, 720
feet to the SE corner of the SW 1/4, SW 1/4, Section
33; thence N 1,322 feet, more or less, along the East
side of said SW 1/4, SW 1/4 to the Northeast corner
thereof; thence W 1,320 feet to the point of beginning,
subject to the right-of-way 100 feet wide granted to
Choctaw, Oklahoma and Gulf (now Chicago, Rock Island
Pacific Railroad Company) on April 12, 1902; and
subject the right-of-way of the Highway known as the
River Road (now Lincoln Avenue);

That part platted as Caldwell Addition to the City of
Little Rock; and subject to the right-of-way 100 feet
wide granted to Choctaw, Oklahoma and Gulf Railroad
Company (now Chicago, Rock Island and Pacific Railroad
Company) on April 12, 1902; and subject to the
right-of-way of Highway known as the River Road (now
Lincoln Avenue), City of Little Rock, Pulaski County,
Arkansas, in the NE corner of Riverfront Road and
Cantrell Road.
WHEREAS, the Ordinance was to have taken effect upon
final approval of the plan by the Little Rock Planning
Commission; and
WHEREAS, the Owner has not submitted a final
development plan/plat within the prescribed time; and
WHEREAS, the Planning Commission by resolution on
January 26, 1988, recommended that the above described
property be reclassified and that the PCD classification be
revoked.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That Ordinance No. 15,195 is hereby
repealed.
SECTION 2. That the preliminary site development
plan/plat approved by Ordinance No. 15,195 is hereby
revoked.

RESOLUTION NO.
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LITTLE ROCK ENDORSING A PROPOSED POLICY
WHICH SUPPORTS QUALITY GROWTH FOR THE CITY OF
LITTLE ROCK; AND FOR OTHER PURPOSES.
WHEREAS, the Little Rock Planning Commission has
reviewed the attached proposed quality growth resolution
(Attachment A), and
WHEREAS, the Planning Commission is committed to
quality growth for Little Rock, and
WHEREAS, the Commission recognizes the importance of
utility extensions, inter -local agreements, voluntary and
pre -annexation agreements, subdivision controls and
extraterritorial zoning in the expansion of the City, and
WHEREAS, the Planning Commission agrees with
discouraging utility expansion outside Little Rock's city
limits, and
WHEREAS, the Planning Commission agrees that an update
to the current growth policy statement is desirable.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING
COMMISSION OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The Planning Commission hereby endorses the
proposed resolution (Attachment "A") concerning the future
expansion of the City of Little Rock.
SECTION 2. This resolution is in full force and effect
from and after its adoption.

30 SECTION I. It is the specific intent of the City
Rock to discourage utility expansion in areas outside current City
31 jurisdiction exercised by

33 the City of Little Rock as provided for by

amended, and Act 56 of 1987, Acts of Arkansas, individual water

3 utility tie-ons shall only be allowed where the land in question
4 meets adopted City zoning and subdivision regulations for the
5 area. provided further, that in no event shall a water utility
6
tie -on be allowed for any of said property within Little Rock's
7
extraterritorial jurisdiction unless said property is first
8 annexed to the City or the owner(s) of said land agree to execute
9 an acceptable pre -annexation agreement with the City providing for
10 the future annexation of said land at a time to be determined by
11 the City. The Board of Directors will determine on an individual
12 case basis where extraordinary exceptions to this resolution may
13 justify tie-ons as determined by established criteria designed to
14 ensure .the orderly growth of the City of Little Rock.
15 SECTION 2. No sewer utility main extensions or individual
16 tie-ons shall be allowed in incorporated or unincorporated areas
17
outside of the City of Little Rock without prior approval of the
18 Little Rock Board of Directors.
19 SECTION 3. No new water main extensions shall be allowed in
20 areas outside the City without the approval of the Little Rock
21 Board of Directors.

SECTION 4. All existing agreements for water and sewer
23 service to incorporated areas outside of Little Rock shall be
24 amended to provide for limits.on service volume. The agreements
25
shall be in written form, and shall be approved by the Little Rock
26 Board of Directors. The intent of this Section is to prohibit
27 further expansion of sewer service volume or resale of water by
28 said incorporated areas receiving Little Rock water or sewer
29 service.
30 SECTION 5. Resolution 5,920 adopted April 14, 1978 is
31 hereby rescinded.

AN ORDINANCE AMENDING SECTION 43-2 OF
THE CODE OF ORDINANCES OF THE CITY OF
LITTLE ROCK (ZONING MAP - SHELL BLAKELY
"SHORT -FORM" PCD (Z-4743).
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That Section 43-2 of the Code of Ordinances
of the City of Little Rock, Arkansas, is hereby amended by
amending the map referred to in that section to the extent
that the Shell Blakely PCD District is hereby amended to
comply with the ordinance repealing Ordinance No. 15,195 and
that section is hereby designated as "I-2" Industrial
zoning.
