The Little Rock Flood Hazard Prevention Ordinance prohibits alteration of the floodway for development purposes. The eastern 500' is being platted into three lots for development. Usable lot depths range between 270' and 110' with the higher depth on the east end of the property. The nearest developable point to any residential property boundary is about 120' away, and that property has a 65' drainage easement which contains a part of the floodway which further separates its developable property from that of the applicant. STAFF RECOMMENDATION: Staff recommends approval of "I-2" zoning on that portion labeled as Lots 1, 2 and 3 and approval of "O-S" Open Space zoning on that portion labeled Tract A on the plat. PLANNING COMMISSION ACTION: The applicant was present and there were no objectors. After considerable discussion about the relative merits of "I-2" zoning versus the stronger compatibility desires of the property owners to the north for "C-3," the Commission moved to approve "C-3" General Commercial. The motion passed - 7 ayes, 0 noes, 3 absent, 1 abstention (Wright). July 13, 1982 SUBDIVISIONS Item No.7 NAME: r_nrAmrMI. Smith 401 Victory Little Rock, AR Phone: 371-6666 NO. OF LOTS: 3 VARIANCES REQUESTED: None. A. EXISTING CONDITIONS FT. OF NEW ST: 0 The majority of this property lies in the Rock Creek Floodway. A minimal amount of vegetation is present since much of the property has been filled to get it out of the floodplain. A residential area abuts on the south, current zoning is "R-5." B. DEVELOPMENT PROPOSAL This is a proposal to plat a tract of 11.2 acres into three lots for industrial use. No variances have been requested. C. CONFORMANCE TO ORDINANCE Minor technical revisions are required on the plat. The applicant has not provided a 50' buffer and 6' opaque fence adjacent to the residential area, which is usually required in "I-2" districts (see Analysis). D. LEGAL CONSIDERATIONS None. July 13, 1982 SUBDIVISIONS Item No. 7 - Continued E. ENGINEERING CONSIDERATIONS (1) Lots 1, 2 and 3: Request in lieu contribution for improvements along West Markham Street to arterial standards. Estimate of improvements to be prepared by owner's Engineer and reviewed by Public Works Engineering. (2) Discuss drainage easement with committee. F. ANALYSIS This property has a severe flooding problem resulting in a minimal amount being suitable for building. City Engineering has indicated no problems in regards to the floodway and the proposed design; however, there is a question for discussion concerning whether or not a drainage easement is needed across the property. Because of the totally undevelopable nature of Tract A, no street improvements are required along its boundary. The applicant should request "OS" Open Space zoning for this tract. In lieu fees for improvements are . • requested for the remainder. Usually, a 6' fence and buffer are required when an industrial use abuts a residential area. In this instance, it is not necessary due to the environs. Staff is requesting that the applicant provide for controlled access points at interior lot corners instead of the two driveways a lot, which is the usual requirement. G. STAFF RECOMMENDATION Approval, subject to comments made. H. SUBDIVISION COMMITTEE RECOMMENDATION: A brief discussion was held resulting in the Committee recommending approval of the plat, subject to: 1) Provide in lieu fees as determined by the City Engineer for Markham Street, adjacent to Lots 1, 2 and 3. 2) No drainage easement to be noted on the plat for the floodway, but that a buildable elevation for each lot be noted. 3) No improvements on West Markham Street adjacent to Tract "A". The vote: 4 ayes, 0 noes, 1 absent. July 13, 1982 SUBDIVISIONS Item No. 7 - Continued I. PLANNING COMMISSION ACTION: The staff gave the report. Mr. Joe White represented the applicant and stated concurrence with staff's recommendation. Engineering commented that they did not request the usual one in ten drainage design easement in this instance because the actual floodway line is under study. There is a possibility in the future that more land would be available for these three lots. So, they requested an option of asking for an easement in the future depending on the outcome of the study. Mr. White agreed to this. Two persons spoke relative to the item. Mr. Jim Conton, a property -owner to the south, wanted to,know what the property was designed for and why the usually required 40' buffer and 6' fence were exempted. Staff answered that they were not needed because there was enough of a buffer in the creek bed and the 6' fence wasn't useful since the homes were at higher elevations than the creek. Mr. Danny Thomas, a property -owner with 40 acres across the street, urged the Commission to take the necessary precautions to ensure adequate drainage in the area. A motion for approval, subject to comments made, was passed by a vote of 9 ayes, 0 noes and 2 absent.
