NEW STREET: 0 LF CURRENT ZONING: C-3, General Commercial District PLANNING DISTRICT: 2 — Rodney Parham CENSUS TRACT: 22.05 VARIANCES/WAIVERS REQUESTED: A variance to allow signage without public street frontage. A. PROPOSAL/REQUEST: Kroger/Delta Marketing is proposing the placement of a fuel center within the existing parking area of the Kroger Store located at 315 North Shackleford Road. The site is currently zoned C-3, General Commercial District and has an existing building in place. The applicant has indicated the fuel center will contain four fueling stations along with an 8-foot by 14-foot kiosk to be manned by one attendant. The applicant has indicated the fuel center will be open seven days per week with the hours of operation from 6 am to 11 pm. The applicant has indicated additional items to be sold from the kiosk are candy, cigarettes and automobile supplies (brake fluid, oil, etc.). August 18, 2005 SUBDIVISIO ITEM NO.: 4 (Cont.) FILE NO.: S-706-A The applicant has indicated the four gas pumps will be parallel to North Shackleford Road, running North and South. The applicant has indicated signage will be placed on the canopy on three sides. The applicant has indicated signage along the north and south facades of the canopy. The applicant has indicated the canopy will provide ample lighting through recessed fixtures to compensate for the removal of existing light poles. B. EXISTING CONDITIONS: The Kroger site is developed with landscaping, parking and a 44,477 square foot grocery store. There are commercial uses located in the area abutting Shackleford Road to the south of the site on both the east and west sides of Shackleford Road. To the north is a mega church and to the northwest is an elementary school. Immediate west, of the site is a strip retail center and a daycare facility. C. NEIGHBORHOOD COMMENTS: All property owners located within 200-feet of the site, the Walnut Valley Neighborhood Association and the Beverly Hills Property Owners Association were notified of the public hearing. As of this writing staff has not received any comment from area residents. D. ENGINEERING COMMENTS: Public Works Conditions: 1. Shackleford Road at this location is classified as a collector street on the Master Street Plan, with additional lanes at the intersection of Mara Lynn Road. Plans show the right-of-way line in the street. Past construction projects if public should have dedicated right-of-way to at least the back of the sidewalk or drainage structure as appropriate. Update survey information to show all past right-of-way dedications. E. UTILITIES AND FIRE DEPARTMENT/COUNTY PLANNING: Wastewater: Sewer available not adversely affected. Entergy: No comment received. Center -Point Energy: Approved as submitted. SBC: No comment received. Central Arkansas Water: Contact Central Arkansas Water regarding the size and 2 August 18, 2005 SUBDIVISION ITEM NO.: 4 Cont. FILE NO.: 5-706-A location of the water meter. Contact the Little Rock Fire Department to obtain information regarding the required placement of the hydrant(s) and contact Central Arkansas Water regarding procedures for installation of the hydrant(s). It appears that the fire hydrant will be private. Fire De artment: Approved as submitted. County Planning: No comment. CATA: The site is located on CATA Bus Route #5 — the West Markham Bus Route. F. ISSUESITEC HNICALIDESIGN: Planning Division: No comment. Landscape: The proposed new four vehicle parking area intrudes into the zoning ordinance required 26 foot wide street buffer and landscape ordinance required 9 foot wide landscape planting strip. Landscape ordinance variances require City Beautiful Commission approval. Interior landscape islands that are removed must be relocated. G. SUBDIVISION COMMITTEE COMMENT: (July 28, 2005) The applicant was present representing the request. Staff presented an overview of the proposed development indicating there were additional items necessary to complete the review process. Staff questioned the existing right of way. The applicant stated the survey provided to staff indicated the current right of way but when the church was constructed a turn lane was installed on the Kroger property. The applicant stated the property owner was willing to dedicate the necessary right of way to allow the turn lane and sidewalk: to be contained on City owned property. Staff stated upon dedication the required landscaping would no longer be in place. The Plans Development Administrator stated if the street was existing no landscaping upgrades would be required. Public Works comments were addressed. Staff stated the applicant should dedicate the right of way necessary to allow the roadway and sidewalk to be constructed on public property. Landscaping comments were addressed. Staff stated the existing site plan indicated interior landscaping sufficient to meet the minimum ordinance requirements. Staff questioned the indicated parking spaces adjacent to Shackleford Road. The applicant indicated the spaces were existing. Staff stated the spaces should be removed from the site. FILE NO.: S-706-A placement of the fueling center on the site the spaces were more likely to be utilized and staff was concerned with customers backing out of the spaces so near the driveway. Staff noted comments from the other reporting departments and agencies suggesting the applicant contact them individually for additional clarification. There was no further discussion of the item. The Committee then forwarded the item to the full Commission for final action. H. ANALYSIS: The applicant submitted a revised site plan to staff addressing most of the concerns and issues raised at the July 28, 2005, Subdivision Committee meeting. The applicant has indicated the existing right of way and the proposed right of way dedication. The applicant has also indicated areas of existing landscape islands and the location these islands will be relocated to on the proposed site plan. The applicant has indicated six landscape islands encompassing 534 square feet will be removed and six landscape islands encompassing 931 square feet will be added to the site to replace the islands to being removed. The applicant has also indicated removal of the four existing parking spaces located near the entrance from North Shackleford Road and indicated the area will be landscaped per City ordinance. The site plan does not allow for the required street buffer along North Shackleford Road. The street buffer was removed with the placement of the turn lane constructed to serve the new church site located to the north. Staff is supportive of the reduced street buffer in this area since this is an existing condition created by the previous expansion of North Shackleford Road. The applicant has indicated the fuel center will contain four fueling stations along with an 8-foot by 14-foot kiosk to be manned by one attendant. The applicant has indicated additional items to be sold from the kiosk are candy, cigarettes and automobile supplies (brake fluid, oil, etc.) with a small area of outdoor display of automobile service products. The applicant has indicated a location for air water and telephone station. The site plan indicates these amenities will be located near the northern boundary of the site within the landscaped area. The applicant has indicated the four gas pumps parallel to North Shackleford Road, running north and south. The applicant has indicated signage will be placed on the canopy on two sides. The applicant has indicated signage along the north and south facades of the canopy. The applicant has indicated the canopy sign will contain a price sign of 3-feet 6-inches by 13-feet and a Kroger logo sign of 3-feet 6-inches for a total sign area of 121.92 square feet. The applicant has indicated the canopy will provide lighting through recessed fixtures and will be directed downward into the site. The applicant has indicated a 4 August 18, 2005 SUBDIVISION ITEM NO.: 4 (Cont.) FILE NO.: S-706-A maximum canopy height of 20-feet 7-inches. The applicant has indicated the fuel center will be open seven days per week with the hours of operation from 6 am to 11 pm. The site contains an existing building with 44,447 square feet and 202 parking spaces. The applicant is proposing the placement of a kiosk containing 112 square feet and the removal of 44 parking spaces to accomplish the proposed new construction. The total parking spaces on the site after the new construction will be 158 parking spaces. Based on typical minimum parking requirements a commercial establishment of this nature requires 148 parking spaces. The indicated parking is more than adequate to meet the typical minimum parking required for a commercial establishment. To staffs knowledge there are no outstanding issues associated with the proposed request. Staff feels the placement of the fuel center within the existing parking area and the removal of the indicated parking spaces should have minimal impact on the adjoining properties. STAFF RECOMMENDATION: Staff recommends approval of the request subject to compliance with the conditions outlined in paragraphs D, E, F and H of the above agenda staff report. Staff recommends approval of the requested variance to allow wall sings without direct street frontage on the north and south facades of the canopy. PLANNING COMMISSION ACTION: (AUGUST 18, 2005) The applicant was present representing the request. There were no registered objectors present. Staff presented the item with a recommendation of approval of the request subject to compliance with the conditions outlined in paragraphs D, E, F and H of the agenda staff report. Staff also presented a recommendation of approval of the requested variance to allow wall signage without direct street frontage on the north and south facades of the canopy. There was no further discussion of the item. The chair entertained a motion for placement of the item for inclusion on the consent agenda for approval. Provide notification of property owners located within 200-feet of the site, complete with the certified abstract list, notice form with affidavit executed and proof of mailing. 2. Provide the sign area for the indicated canopy signs including the total height and total length of the proposed signage in the general notes section of the site plan. 3. The applicant has indicated the hours of operation from 6 am to 11 pm seven days per week. 4. The site plan indicates four gas pumps and a kiosk of eight feet by. fourteen feet. Additional items indicated to be sold from the kiosk are candy, cigarettes and auto supplies. Will there be any outdoor display of any items to be sold? 5. The existing Kroger store is 44,447 square feet and there are 158 parking spaces proposed after the addition of the kiosk (44 parking spaces will be removed). The ordinance would typically require 148 parking spaces based on the indicated square footage. Four spaces have been indicated near the kiosk adjacent to Shackleford Road. 6. The site plan also includes the placement of a station to dispense air and water. The air, water and telephone have been located within the main drive isle of the shopping center. Relocate these items away from the main drive isle. 7. Will there be a dumpster located on the site? If so indicate the proposed location of the dumpster along with a note concerning the proposed dumpster screening. 8.
