Dear Ms. James:
On behalf of Kroger Limited Partnership I, Pickering is pleased to resubmit the site plan for the
proposed Kroger Fuel Center at the above referenced Kroger store. We are requesting that the
site plan review be placed on the agenda for the August 18, 2005, Public Hearing. In response
to the Subdivision Committee comments dated July 28, 2005, Item No. 4, File S-706-A:
Planning Staff Comments
1: Notifications have been sent, copy of the certified abstract list submitted with packet.
2: Canopy sign details, with all applicable dimensions, added to Sheet C.2, rear price sign
removed as discussed at the meeting on 7/28/05
3: Correct
4: All correct. A small outdoor display will be used for auto service products (oil, gas treatment,
etc.)
5: All correct
6: Air Water & Telephone Station relocated to northern landscaped area out of main drive
7: Gas Station will use existing Kroger's Dumpsters
8: See Sheet C.2
Public Works Conditions
1: David Hamilton in Public Works claims no prior dedication has been made, however new
proposed R.O.W. line is shown on drawings, and area will be dedicated to the city pending
site plan approval
Central Arkansas Water
1: Daniel Tull reviewed confirmed size and location of lines, meters, and hydrants. Fire Hydrant
is within 150 feet of the kiosk, as the hose would lie.

1: As per the decisions made at the meeting on 7/28/05, no additional landscaping is required. 6
landscape islands encompassing 534 sf to be removed; 6 landscape islands encompassing 931 sf
to be added.
We appreciate your consideration in this matter. Attached please find: 4 sets of our revised
plans (5 pages per set: Cover Page, Existing Conditions/Demo Plan, Site Plan, Utility Plan, and
Grading Plan), a copy of the abstract completed by Beach Abstract & Guaranty Company, Inc., a
copy of the notices (signed Affidavit) sent to business, copies of the certified mail receipts, and a

Donna:
Attached please find a .pdf file of the .dwg file (also attached) showing the new proposed property line that would
include a future right-of-way dedication. David Hamilton has seen this .pdf file and has approved it for purposes
of planning review.
The .dwg file is identical to the one you have seen before except for: the addition of a magenta property line, the
section of the old property line being removed is now a cyan color, and there is a new layout entitled "ROW -
Dedication." Unfortunately, due to lack of space available and the lack of time to create such space, the bearings
and distances of the new ROW line are NOT included in the "layout" tab. However, the bearings and distances
are included in the "ROW -DEDICATION" tab, and thus some cross-referencing may be required. Else, I will be in
the office until the meeting Thursday and hope that you will call or email with any further issues.

First and Foremost, my project manager won't be back to the office until Monday and hence the
remainder of this letter is just my speculations from data I've been able to collect.
It appears that the property lines on our survey might have been based on a previous survey that had a

straight R/W 30 feet from the center line with an additional 10 feet dedicated to the city (I have a copy of
a "Final Plat" done by AMI Engineering inc. out of Little Rock, AR dated 8/8/1986). From pictures we
took, it seems that a right turn lane was,added after the original road was completed (there is a definite
line in the road suggesting a split in pavements). This lane might have been added in order to assist the
Immanuel Baptist (?) church that was added North of the Kroger, which shares a drive to and from with
Kroger. Our site plan does include such a right turn lane that comes inside of the property line, which I
believe is where your issues arise.
Again I will not be able to state anything defiant until Monday, but if you could find any up to date plans
(or any plans for that matter) of N. Shackleford Rd. and email/fax/mail them to me, that would definitely
assist us in getting back to you quicker and with better information.

We had our staff meeting this morning and we have some questions as to the overall site layout. Is the
survey and site plan based on an existing survey? The site plan indicates portions of the city street are
located on Kroger's property. We questioned if this was in fact the case. If in fact the survey does not
indicate the previously dedicated right of way the setbacks are not correctly indicated. We need to
clear up the current property line so we can addresses issues related to landscaping, setbacks, etc..

Dear Ms. James:
On behalf of Kroger Limited Partnership I, Pickering Inc. is pleased to submit the following attached items in order for the City
of Little Rock to review and approve: site plan review application, civil construction plans, and payment for associated fees.
The attached plans indicate the addition of a Kroger Gas Station to the existing Kroger on N. Shackleford Rd. The Plans include
a cover sheet, an existing conditions/demolition plan, an overall site plan, an enlarged utility plan for existing and proposed
conditions, and a grading sheet. These attached plans detail the fuel center's location relative to existing structures, layout of the
proposed fuel center, utility arrangement after the construction of the ftiel center, proposals to insure no flooding will occur,
charts describing pre- and post -construction parking spaces available for use, and other pertinent details affected by the
installation of the fuel center.
Currently, Kroger is the sole occupant of a 4.78 acre, C-3 Parcel on N. Shackleford Rd. The existing Kroger Grocery Store is at
315 N. Shackleford Rd. and is located due North of West Markham St. At this time Kroger's development plans include only
the above -mentioned gas station. The proposed fuel center will be owned and operated by The Kroger Company, and is a
permitted use in the current C-3, General Commercial zoning district.
The existing Kroger grocery store in the 4.78-acre lot encompasses about 44,447 square feet. According to Little Rock's
Planning and Zoning Codes, any shopping center should contain 4 spaces plus 1 space per every 300 square feet of gross floor
area. Due to the size of the Kroger grocery store (over 40,OOOsf) an 80% reduction factor can be applied to square footage for
purposes of parking calculations. As presented in the site plan Kroger's parking lot will still provide one space per every 231.5
sf of floor area post construction.
The Kroger Fuel Center will be in the northwest corner of the parking lot, at a distance to easily conform to required building
setbacks and to clear existing utility easements (listed in plans). One attendant will occupy an 8'xl4' Kiosk located on the east
side of the fuel center 7 days a week between the hours of 6am and 1 1pm. Items available at the kiosk will be candy, cigarettes,
and automotive supplies (oil, brake fluid, etc.) There will be four gas pumps lined up parallel to N. Shackleford, running North
and South. Similar to other Kroger Fuel Centers existing in Little Rock, this fuel center will only contain canopy signage.
These canopy signs' sole purpose will be advertising the price of the gasoline at the fuel centers and will be the only presentation
of price. Two signs on both the south and north side will advertise the price to commuters on N. Shackleford Rd., while one sign
on the east side of the fuel center will display the price to shoppers leaving the existing Kroger grocery. The canopy itself will
provide ample lighting through recessed fixtures to compensate for the removal of the existing light pole.
Attached with this cover letter, please find: a site plan review application, 3 sets of civil construction plans, 3 surveys, 18 copies
