A. PROPOSAL/REQUEST:
This applicant proposes to construct a freestanding
building with drive-thru on the northwest corner of
Rodney Parham and Reservoir Roads. This structure will
be a frozen yogurt store and be on the ground leased
from an Exxon gas station. The TCBY building is a
total of 812 square feet with 208 square feet allocated
to customer seating. The remaining 604 square feet
will be used for preparation, storage and rest rooms.
The applicant plans to provide ten parking spaces.
B. EXISTING CONDITIONS:
This property is generally a small flat tract of ground
abutted by an Exxon gas station to the south and
Casey's BBQ to the north. The adjacent street, is
developed to City standard.
C. ENGINEERING COMMENTS:
There are none to be reported at this time.

D. ISSUES/LEGAL/TECHNICAL DESIGN:
There are no issues involved on this site plan.
E. ANALYSIS:
The Planning staff review of the site plan reveals no
problems with the proposal as presented.
F. STAFF RECOMMENDATION:
Staff recommends approval as filed.
SUBDIVISION COMMITTEE COMMENT:
(March 1, 1990)
The applicant was not present. This matter was discussed
briefly. The two points that were indicated by the
Committee for further review were closing of one curb cut on
Reservoir Road and closing one access to TCBY from the Exxon
station.
There being no further discussion on the matter, this item
was forwarded to the Commission for final resolution.
STAFF REPORT AND UPDATE:
The staff called the applicant to introduce the Committee
concerns for this site plan. Mr. Carl Menyhart, the
architect, agreed to consider the above options for review
with the Exxon representative for this project.

PLANNING COMMISSION ACTION:
(March 13, 1990)
The Planning staff presented its recommendation on this
matter, the recommendation being approval of the revised
site plan as filed.
The Chairman then asked the applicant to present his
application. Mr. Menyhart offered a lengthy presentation
explaining the joint venture of the Exxon station and TCBY
proposed development.
Commissioner Perkins indicated that closing the curb cut on
the Exxon site and eliminating the drive makes a significant
improvement for this development.

The Commission Chairman then asked the individual seeking
more information to express his concerns. This person was
Don Henry, owner of Casey's Bar-B-Que located directly north
of the TCBY site. Mr. Henry's main concern was traffic
problems on Reservoir Road. He stated that he had met with
a traffic engineer. According to the Traffic Department,
changes will occur in the near future after they alter the
timing of the stop light.
A member of the Commission then called the question. A
motion was made to approve this revised site plan as filed.
The motion passed by a vote of 10 ayes, 1 nay (Kathleen
Oleson) and 0 absent.
