HomeMy WebLinkAbout19615ORDINANCE NO. 19,615 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED INDUSTRIAL DISTRICT TITLED ACCURATE BORING SHORT -FORM PD -I (Z- 8089), LOCATED AT 12601 -B ALEXANDER ROAD, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from R -2 to PD -I: Part of Lot 1 Mark Roberts Addition to the City of Little Rock, Pulaski County, Arkansas, as recorded in Plat Book H, Page 178, being more particularly described as follows: Commencing at the Northwest corner of the said Lot 1, Mark Roberts Addition, thence S00 °22' 16 "W a distance of 341.91 feet to the Point of Beginning for re- zoning; thence N89 °14'24 "E 160.0 feet; thence S00 °22' 16 "W a distance of 275.0 feet; thence S89 °14'24 "W a distance of 160.0 feet; thence N00 °22' 16 "E a distance of 275.0 feet, returning to the point of beginning containing 44,000 square feet or 1.010 acres, more or less. SECTION 2. That the approval of the Accurate Boring Short-form PD -I (2- 8089), located at 12601 -B Alexander Road is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report. • The approval is for the sole benefit of the current applicant David Thornton and is not a transferable use to any future property owner with no expansion allowed. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Accurate Boring Short-form PD -I (Z- 8089), located at 12601 -B Alexander Road is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
