To allow construction as minor residential street standard. A. PROPOSAL/REQUEST: ........... ..... ..... ... ............_..................... ..... ....... .. This developer proposes the platting of one residential lot on a large unplatted tract of land and moving the right-of-way to meet minimum front building setbacks for a large family home. B. EXISTING CONDITIONS: The land varies in elevation. The front part is gentle slope changing to steep slope in the east and central area of the lot. The lot is partially cleared with some natural foliage on the steep part. There are no structures on the site. The only access to the site is by Scenic Boulevard. 1 December 12, 1989 SUBDIVISION Item No. _3�(Continued) C. ENGINEERING COMMENTS: Request for minor residential classification is supported. The applicant should verify existing right- of-way of Scenic Drive. Stormwater Detention Ordinance applies. D. ISSUES/LEGAL/TECHNICAL/DESIGN: There are not many significant issues attached to this plat. The only item of concern expressed by Planning staff has to do with including and naming the abutting property on the plat called "reserve" at the moment. The only remaining issue that should be dealt with as soon as possible is filing a petition with our staff and the City Clerk for right-of-way abandonment so it can be included as a part of this plat. E. ANALYSIS: The staff review of this preliminary plat indicates few legal issues. The two points made in Item D above are the primary concerns of Planning staff. The remaining large undeveloped piece of land needs to be identified as an unbuildable lot because of the depth and be included in the Bill of Assurance for further maintenance. F. STAFF RECOMMENDATION: Staff recommends approval of this plat subject to: 1. The Engineer of Record filing a petition for right-of-way abandonment. 2. Naming and including "reserve" on the final plat. 3. Including "reserve" in the Bill of Assurance for further maintenance. SUBDIVISION COMMITTEE COMMENTS: (November 30, 1989) The application was represented by Pat McGetrick. The applicant indicated that he had read through the staff's material on this proposal and did not have questions concerning the plat. 2 December 12, 1989 SUBDIVISION Item No. 3 (Continued)— The only issue that still needed to be resolved is the street right-of-way abandonment. Jerry Gardner informed the applicant that the petition for right-of-way abandonment needed to include all property owners who have point contingency with this right-of-way. He also advised the applicant to visit with Steve Giles, Assistant City Attorney, to get more specific information. PLANNING COMMISSION ACTI.ON: (December 12, 1989) The applicant was represented. The Planning staff reported that it was appropriate to place this item on the consent agenda for approval subject to Mr. Pat McGetrick and the Planning staff working out the right-of-way issues. A brief discussion followed during which the Commission determined it.appropriate to place this item on the consent agenda for approval with the conditions specified by staff. A motion to that effect was made and passed by a vote of 11 ayes, 0 noes, 0 absent. 3
