My response to your first question as to the zoning of the property is that this site is currently classified "III-12" Multifamily District which classification permits a maximum of 12 dwelling units per gross acre of land. As to your second question concerning the use of right-of-way, there are two issues associated with this issue; first of which is the current right-of-way not needed for the Mara Lynn/Napa Valley realignment will require abandonment by the City by Ordinance. This portion will become a part of the development area and without question may be used for determination of density. The second issue is that portion of the right-of-way of the current Mara Lynn Road which will remain within the four lane 80' wide facility. This area of land to the centerline of the roadway along the north boundary of this property may be utilized in computing density. As to the third question in your letter, the southern portion of this land lies within the floodplain of Rock Creek and as such, City Policy and Ordinance will require that portion of the property lying within the floodway be dedicated to the City of Little Rock at the time of filing of the final plat for record. This event can occur either' before the issuance of the building_ permit or after, depending upon the manner in which a site plan is approved;. In closing, let me add to the above comments a reminder that additional -proposals to develop this property in the general fashion of k-1ighland Ridge Apartments will require Planning Commission review and approval as a subdivision multiple structure site plan. I need verification of current zoning status of above mentioned property. Also, as you recall from a previous application on this property, the city agreed to allow the prospective developers to use the right-of-way portion__that will be lost to the city to figure their density allowance. Would you please copy me on the history of that situation and as it will pertain to another group of developers we are currently working with. Another item I will need clarification on is the portion of the property that is in the flood plan and what will be the disposition of it, in regards to city requirements. If there is any other information pertaining to this partial.of land that would effect any future decisions on how it could be developed, I would appreciate you covering them in your response.
