This office has reviewed the file on Eagle Pointe as well as the City Clerk's records resulting in no factual evidence that your letter of September 15, 1987 was entered into the record. However, I am advised by Mr. Joe White that his client has agreed to the basics of the letter including the fence on the west line; the landscaping (trees) reflected on the site plan; a 25 ft. buffer and some review of the Bill of Assurance by Doctor and Mrs. Gold. The utility easement for the Gold's sewer is to be shown on the plat. I believe this closes this matter at this time, but I will monitor the issue. I am enclosing a copy of my September 15, 1988, letter, which is a part of the file in the case. I understand that the final plat for Eagle Pointe is being circulated currently to the utilities, or soon will be, for final placement of their easements. Dr. and Mrs. Gold have subdivided their six acres into two three -acre tracts and intend to build a new home for themselves on the rear three acres. Both homes would be served by septic tanks. However, since the area is becoming more built up, they are inclined to think it would be appropriate to go ahead and connect to the City's sewer system, which I assume the City would encourage. Consequently, they request the City to require dedication of an easement for a sewer line between two of the lots in the northwest quadrant of Eagle Pointe as a condition for final plat approval. This could be done without any inconvenience or expense to the developer, since the line would be put in by the Golds and it would not interfere with the development of the lots. They also have other concerns. The September 15 agreement contemplates the construction of the fence prior to construction of the streets, etc. in Eagle Pointe. This agreement calls also for certain terms to be included in the bill of assurance with reference to trees, a request for a waiver on the height of the fence, and land- scaping on the Golds' property. To avoid further misunder- standings as to the requirements of the agreement, the Golds strongly suggest the following Steps be required by the City: 1) Review by the Golds of the bill of assurance prior to final approval and recordation; 2) Confirmation of the fence height waiver request and the terms thereof; 3) Submission of plans or sketches of the proposed fence and pillars to the Golds prior to construction of the fence; and 4) Submission to the developer by the Golds and agreement upon the landscaping plan for the appropriate area of the Golds' property before that work commences. (By the way, they understand that replacement of trees on their property occasioned by their new sewer line would be their responsibility.) By copy of this letter, I am communicating the request for the sewer easement to the Waste Water Utility as well. Please let me know the City's position on this request as soon as you can. Thanks. Before beginning significant construction of improvements on the site, the developer will construct a fence on the west property line to the maximum height allowable by the City (up to 3 Feet, developer to request any necessary waivers), consisting of masonry pillars connected by solid wooden fencing. The Golds will grant a temporary easement across their property to permit this fence to be constr"cted from the west side. 4. After construction of the fence, the developer will plant trees on the west side of it, on the Golds' property, of a type and to a density (when added to existing trees) consistent with those trees lying in the uncleared, unpaved areas between Ridgehaven and the front of 'che Golds' home. 5. Although, the application will be submitted to the Board of Directors showing no access to the project from Ridgehaven, the developer is willing to honor any consensus from the neighbors in this regard ---that is, if a majority of the residents prefer an access point toward the west side of the project, the developer is willing to include such access in its final plans, if timely submitted. However, the Golds understand that any such access will require City approval, and their waiver of the 40-foot open space requirement is not conditioned on the access being actual} provided, since failure to obtain either neighborhood or City approval would necessarily preclude such access. 6. The developer will have this letter placed in the record, as evidence of its consent. Thank you.
