RIGGS, IN AN AMOUNT NOT TO 5 EXCEED THREE HUNDRED TWENTY-SIX THOUSAND, SEVEN 6 HUNDRED SIXTY-THREE AND 41/100 DOLLARS ($326,763.41), PLUS 7 APPLICABLE TAXES AND FEES, FOR THE REMANUFACTURE OF 8 UNIT NO. 04N132, CAT D6R DOZER FOR THE PUBLIC WORKS 9 DEPARTMENT SOLID WASTE DIVISION; AND FOR OTHER 10 PURPOSES. 11 12 WHEREAS, the Public Works Department Solid Waste Division has demonstrated the need to 13 remanufacture Unit No. 04N132, CAT D6R Dozer, to ensure that the operations at the City's Landfill 14 continue to operate without delays; and, 15 WHEREAS, the blade utilized to push the trash and dirt for daily coverage at the Landfill does not 16 function properly, and this special Dozer is essential to keeping the operation running; and, 17 WHEREAS,the cost to remanufacture the current Dozer is half the cost of a purchasing and building 18 a new unit; and, 19 WHEREAS, Little Rock, Ark., Resolution No.15,783 (September 6, 2022) and Little Rock, Ark., 20 Resolution No. 15,847 (December 20, 2022) stated the intent to spend American Rescue Plan Act Funds 21 on Public Works Capital needs; and, 22 WHEREAS, the total cost to remanufacture Unit No. 04N132, CAT D6R Dozer shall not exceed 23 Three Hundred Twenty-Six Thousand, Seven Hundred Sixty-Three and 41/100 Dollars($326,763.41),plus 24 applicable taxes and fees. 25 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 26 OF LITTLE ROCK,ARKANSAS: 27 Section 1. The Board of Directors authorizes the City Manager to enter into an agreement with J.A. 28 Riggs, in an amount not to exceed Three Hundred Twenty-Six Thousand, Seven Hundred Sixty-Three and 29 41/100 Dollars($326,763.41),plus applicable taxes and fees,for the remanufacture Unit No. 04N132,CAT 30 D6R Dozer for the Public Works Department Solid Waste Division. 31 Section 2. Funds for this purchase are available utilizing American Rescue Plan Account Funds,TREA 32 Solid Waste Equipment,Account No. 271409-G0601AR40A-72200. 33 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 34 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or [Page 1 of 2] 1 adjudication shall not affect the remaining portions of the resolution, which shall remain in full force and 2 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 3 resolution. 4 Section 4. Repealer.
