This cover letter to be attached to two copies of plat and copy of Bill of Assurance
deliverd to your office yesterday.
Purpose of Replat was to clear up Title, and for future transactions.
Owners of property replated are: Wendy's Old Fashioned Hamburgers at New York, Inc.
and Carolyn M. Hamra, as Executrix of the Estate of Gerald F. Hamra, to wit:
Lot 1, H & K Addition, and Lot 2 S & T Subdivision.
Property deeded to Wendy's was as follows:
Lot 2, S & T Subdivision, less and except the South 80 feet thereof;
AND
The South 91.6 feet of Lot 1, H & K Addition;
AND
Part of the SW41 SW4, Section 31, T-1-11; R-12-W, more particularly described as:
Starting at the SW Corner Section 31; thence North 957.8-feet; thence:-East-50 feet
to Point of Beginning; thence S 89' 50' E 300 feet; thence S 0° 22' E 50 feet;
thence N 89' 50' W 300 feet; thence N 00 22' W 50 feet to the Point of Beginning,
containing 0.34 Acres, more or less.
BILL OF ASSURANCE
KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, WENDY'S OLD FASHIONED HAMBURGERS OF NEW YORK, INC.
and CAROLYN M. HAMRA, AS EXECUTRIX OF THE ESTATE OF GERALD F. HAMRA,
are the sole owners of the following property in Pulaski County, Arkansas, to -wit:
Lot 1 H & K Addition and Lot 2 S & T Subdivision to the City of
Little Rock, Arkansas being a part of the Northwest %,
Southwest A Southwest A Section 31, Township 1 North,
Range 12 West, lying East of the Right -of -Way of Geyer
Springs Road, more particularly described as:
Commencing at the Southwest corner, Section 31, Township
1 North, Range 12 West, thence North 000 22' West 957.3';
thence South 890 50' East 50.0 feet to the East line of Geyer
Springs Road and the Point of Beginning, said point being the
Northwest corner of said Lot 1 H & K Addition; thence continue
South 890 50' East along the North line of said Lot 1 H & K
Addition 300.0 feet to the Northeast corner of said Lot 1 H & K
Addition; thence South 000 22' East along the East Line of said
Lot 1 H & K Addition and Lot 2 of said S & T Subdivision 230.8
feet to the Southeast corner of said Lot 2 S & T Subdivision;
thence South 890 42' West along the South line of said Lot 2
S & T Subdivision 300.0 feet to the East line of said Geyer
Springs Road and being the Southwest corner of said Lot 2 S
& T Subdivision; thence North 000 22' West along said East
line of said Geyer Springs Road 233.2 feet to the Point of
Beginning, containing 1.597 acres more or less.
WHEREAS, it is desirable that all of the above described property be platted and
replatted.
NOW, THEREFORE, WITNESSETH;
THAT WE, WENDY'S OLD FASHIONED HAMBURGERS OF NEW YORK, INC.
and CAROLYN M. HAMRA, EXECUTRIX OF THE ESTATE OF GERALD F. HAMRA,
hereinafter termed Grantors, have caused said lands to be surveyed by W. William
Graham, Jr., Inc., Registered Land Surveyors, and a plat thereof made which is identified
by the title "Lots 1 and 2 of Hamra Subdivision to the City of Little Rock, Arkansas, being
a Replat of Lot 1 of H & K Addition and Lot 2 S & T Subdivision, all a part of the Northwest
%, Southwest %, Southwest Y4 of Section 31, Township 1 North, Range West," and dated
June 3, 1997, and bears the signature of said Engineer and said Grantors, and bears a
Certificate of Approval executed by the Little Rock Planning Commission, and is of record
in the Office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, in
Plat Book , Page , and that the Grantors do hereby make this Bill of Assurance.
The lands embraced in said plat shall be forever known as Lots 1 and 2, Hamra
Subdivision to the City of Little Rock, Pulaski County, Arkansas; and every deed of
conveyance for said property shall use this designation as a good and proper description
thereof.
There are strips of ground shown and dimensioned on said plat each marked
"Drainage and Utility Easement" and "Drainage Easement" reserved for the use of public
utilities and for drainage purposes, and the owners of the replatted property shall take their
titles subject at all times to the proper authorities and to the easements herein reserved.
The filing of the Bill of Assurance and plat for record in the office of the Circuit Clerk
and Ex-Officio Recorder of Pulaski County shall be a valid and complete delivery and
dedication of the streets and easements shown on the said plat.
All buildings constructed on said lots shall be constructed no nearer to the street
than the building line shown on the plat; and all buildings shall be constructed in
conformance with the Building Code and Zoning Ordinance of the City of Little Rock,
Arkansas.
These covenants and restrictions are to run with the land and shall be binding on

all parties and all persons claiming under them for a period of thirty (30) years from the
date of these covenants and restrictions are recorded, after which time said covenants and
restrictions shall be automatically extended for successive periods of ten (10) years,
unless an instrument signed by the then owners of the lots has been recorded; agreeing
to change said covenants and restrictions in whole or in part and any change must be
approved by the Little Rock Planning Commission.
The invalidation of any one of these covenants or restrictions by judgment or court
order shall in no wise affect any of the other provisions; which shall remain in full force
effect.
