HomeMy WebLinkAboutS-0438-A Staff AnalysisSeptember 14, 1982 SUBDIVISIONS Item No. 8 NAME: Wendy's Building Line Waiver LOCATION: 8703 Geyer Spacings Road i REQUEST: A modification of an existing 40' building line to accommodate a structural addition which will extend 10' into the established area. A. EXISTING CONDITIONS This site is located in an area generally characterized by a mixture of commercial uses. It is bounded on the west by Geyer Springs Road, which is a major arterial. All improvements are in place. B. DEVELOPMENT PROPOSAL This proposal involves a request for permission to make an addition to an existing structure which will encroach 10' into an area established by a 40' building line. C. CONFORMANCE TO ORDINANCE The application varies in the manner stated above. D. LEGAL CONSIDERATIONS The Bill of Assurance must be amended and property owners in the Subdivision notified. If approved, a final plat indicating the modified building line is required. E. ENGINEERING CONSIDERATIONS Will comment at meeting. F. ANALYSIS Staff is not opposed to this request since it will not be detrimental to the general area, and it will still be in excess of the required 25' setback in "C-3" Zoning Districts. SUBDIVISION COMMITTEE ACTION The applicant brought this item to the meeting and requested that it be added to the agenda. The Committee agreed. PLANNING COMMISSION ACTION: Mr. Bill Hastings of Rector -Phillips -Morse represented the applicant. There were no objectors. A motion was made for approval, subject to the submission of a replat. The motion passed by a vote of 7 ayes, 0 nays, 4 absent.
