A. PROPOSAL/REQUEST:
The development proposal for this preliminary plat is
one of creation of perimeter lots less than the minimum
requirement for "C-2," Shopping Center District. The
plat will be utilized for purposes of creation of a
one -lot out parcel at the corner of Kanis and
Shackleford Road for placement of a service station.
B. EXISTING CONDITIONS:
The property consists of rolling terrain with the grade
increasing significantly to the south toward the Koger
Development. The site is well covered with natural
foliage.
C. ENGINEERING COMMENTS:
This development should conform to Excavation and
Detention Ordinance requirements. Provision should be
made for compliance with the Master Street Plan right-
of-way on Shackleford and Kanis Road.
D. ISSUES/LEGAL/TECHNICAL/DESIGN:
None.
E. ANALYSIS:
The Planning Staff has reviewed the history of this
corner relative to the "C-2" application approved on
the original 20 acres parcel and the placement of the
several streets that have been constructed crossing
this site. On the occasion of the platting, dedication
and construction of the street system, the developer
agreed to submit a complete preliminary plat on the
property on the occasion of the first lot sale. The
action at hand triggers that requirement.
It is the'believe of the Planning Staff that the
perimeter lot provision in the "C-2" District for
platting was not designed for purposes of allowing
peripheral striping and spot development of a large
"C-2" site. The "C-2" properties now in place do not
have a specific proposal, and it would appear to
Planning Staff that before perimeter lots are created
that the primary development for the "C-2" land should
be in place, or at least approved on the record. This

is especially important in circumstances where two
major arterial streets will intersect and a requirement
for internal circulation between various lots is
important.
F. STAFF RECOMMENDATION:
Staff recommendation is denial of the preliminary plat.
SUBDIVISION COMMITTEE COMMENT: (May 4, 1989)
The application was represented by Mr. Robert Brown. A
brief discussion of this matter determined that this
preliminary plat is in proper order and that any issues
associated with the plat would derive from the discussion of
Item 10 on this agenda which is the site plan review as a
planned commercial district. Therefore, this item was
forwarded to the Commission without further comment.
PLANNING COMMISSION ACTION: (May 16, 1989)
The applicant was present. There were no objectors in
attendance. Staff modified its recommendation to recommend
approval of the preliminary plat. A motion was made to
approve the plat as filed. The motion passed by a vote of
9 ayes, 0 nays and 2 absent.
